- The essay highlights the issues surrounding unaccompanied minors' right to residence in Sweden under "particularly distressing circumstances," especially in light of the legislative change in december 2023 that makes it more difficult for children to be granted residence permits. This is confirmed by statistics showing a significant decrease in approved applications in the year following the law change. This development contrasts with previous regulations, which were intended to include more children, emphasize the child rights perspective, and clarify the consideration of the best interests of the child in the assessment process.

(More) - The essay highlights the issues surrounding unaccompanied minors' right to residence in Sweden under "particularly distressing circumstances," especially in light of the legislative change in december 2023 that makes it more difficult for children to be granted residence permits. This is confirmed by statistics showing a significant decrease in approved applications in the year following the law change. This development contrasts with previous regulations, which were intended to include more children, emphasize the child rights perspective, and clarify the consideration of the best interests of the child in the assessment process.
It is also noted that the state must ensure that the child has arranged reception in the event of a deportation. In practice, the procedure is concerning and contravenes international law. Children are exposed to injustices at the Swedish Migration Agency, where the principle of the best interests of the child is not properly considered. The Migration Agency fails to fulfill its investigative duty, assuming that a child over 14 years old will still be deported on their 18th birthday, regardless of whether the child succeeds in proving the lack of an organized reception. This puts the child in a "limbo" situation. Such uncertainty has a highly negative impact on the child's health and future development. Furthermore, it was noted that in one case, the investigation into available care options in the home country was not sufficient until the case reached the highest court, raising the question: How many cases are inadequately investigated in the lower courts?
Regarding the best interests of the child, this should weigh more heavily than other interests and be prioritized in all cases involving children. The best interests of the child should be seen as an "open concept," but if the legal interpreter fixates on what is considered to be the child's best interests, the interpretation can become too narrow and fail to account for the child's individual circumstances, which differ from child to child.
The Swedish legal system needs improvement to protect children's rights and well-being in order to fulfill its obligations toward unaccompanied minors, who are already in vulnerable positions. These are real children, not just a number in the statistics (Less) - Abstract (Swedish)

år ändå ska utvisas vid 18-årsdagen, oavsett om barnet lyckas bevisa avsaknaden av ordnat mottagande eller inte. Barnet försätts därav i en ”limbo”. En sådan osäker situation har en väldigt negativ påverkan på såväl barnets hälsa
som framtida utveckling. Vidare uppmärksammades att det i ett fall visade sig att utredningen av vårdmöjligheter i hemlandet inte var tillräcklig förrän målet hamnade hos högsta instansen, vilket väcker frågan, hur många fall är det egentligen som är otillräckligt utredda som finns hos de lägre instanserna?
Vad gäller barnets bästa, ska det väga tyngre än andra intressen och beaktas primärt i alla ärenden som rör barn. Barnets bästa ska ses som ett ”öppet koncept”, men om rättstillämparen låser sig vid vad som anses vara barnets bästa, kan tolkningen bli för snäv och inte alltid ta hänsyn till barnets individuella
omständigheter som skiljer sig åt från barn till barn.
Det svenska rättssystemet är i behov av förbättringar för att skydda barnets rättigheter och välbefinnande för att uppfylla sina skyldigheter gentemot ensamkommande barn, som redan befinner sig i utsatta positioner. Det handlar om verkliga barn, och inte bara en siffra i statistiken. (Less)
