Abstract
In Sweden, public procurements involving large sums of money are conducted annually. Procurement processes can be time consuming, but with some organizational planning, public authorities can create favorable conditions to quickly and efficiently meet their needs.
The in-house exception gives authorities the opportunity to procure directly without advertising. For authorities to apply the in-house exception, three things are required. There must be a contracting authority that exercises con-trol over a counterparty, the counterparty must perform the majority of its ac-tivities for the authority, and there should be no direct private ownership inte-rest in the counterparty.

The in-house exception gives authorities the opportunity to procure directly without advertising. For authorities to apply the in-house exception, three things are required. Because of the Administrative Court of Appeal in Stockholm's judgment of October 8, 2024, case no. 1232-24, the question of the activity criterion in the in-house exception became particularly relevant. The purpose of the essay is to analyze the activity criterion in light of the Administrative Court of Appeal in Stockholm's judgment of October 8, 2024, case no. 1232-24. The only conclusion that can be drawn with certainty is that the legal situation is unclear. However, the judgment has been appealed to the Supreme Administrative Court. A judgment from the highest instance could lead to the legal situation being clarified. (Less)

Årligen genomförs offentliga upphandlingar i Sverige för stora summor. Upphandlingsprocesser kan vara tidskrävande men med planering kan offentliga myndigheter skapa goda förutsättningar för att snabbt och effektivt kunna tillgodose sina behov.
In house-undantaget ger myndigheter möjlighet att upphandla direkt utan annonsering. För att myndigheter ska kunna tillämpa in house-undantaget krävs tre saker. Däremot är domen överklagad till högsta förvaltningsdomstolen. En dom från högsta instans skulle kunna leda till att rättsläget klarläggs (Less)
