- Denna uppsats undersöker den historiska och juridiska utvecklingen av principen att domstolar ska beakta barns åsikter i vårdnadstvister i Sverige. Genom en rättshistorisk metod granskar studien utvecklingen av lagstiftningen från tidigt 1900-tal till nutid. Analysen identifierar centrala reformer som in-förde och stärkte kravet på att domstolar ska beakta barns åsikter och diskuterar anledningarna till och argumenten bakom reformerna.
Uppsatsen belyser att samhällsförändringar, ökad förståelse för barns behov och förändrade perspektiv på föräldraskap har format det föräldrabalkens be-stämmelser. Studien visar att det även efter principens inkorporering i lagstiftningen återkommande setts brister i att säkerställa att dessa åsikter tillräckligt beaktas i praktiken. Using a legal-historical method, the study reviews the evolution of legislation from the early 20th century to the present day. The analysis identifies key reforms that introduced and strengthened the requirement for courts to take children's opinions into account and discusses the reasons for and arguments behind these reforms.

Earlier legislation focused on parental responsibility and authority, while... Using a legal-historical method, the study reviews the evolution of legislation from the early 20th century to the present day. The analysis identifies key reforms that introduced and strengthened the requirement for courts to take children's opinions into account and discusses the reasons for and arguments behind these reforms.
The thesis highlights that societal changes, increased understanding of children's needs, and evolving perspectives on parenting have shaped the provisions of the Swedish Parental Code. Earlier legislation focused on parental responsibility and authority, while modern reforms prioritize children's autonomy and rights. The UN Convention on the Rights of the Child, particularly Article 12, has further reinforced the principle of listening to children in Swedish legislation. The study shows that even after the principle was incorporated into legislation, there have been recurring challenges in ensuring that children's opinions are adequately considered in practice. These challenges have been used as justifications for further reforms, such as the 2021 amendment where “will” was replaced with “opinion”.
The findings underscore the importance of adapting legal practices to changing societal norms and international commitments to children's rights. (Less)
