- Syftet med uppsatsen är att undersöka gränslandet mellan offentlig upphandling, entreprenadrätt och försäkringsrätt. Fokus ligger på att analysera fullgörandeförsäkringens funktion och de problem som kan uppstå vid dess tillämpning i relation till standardavtalen AB 04 och ABT 06 samt Lagen om offentlig upphandling (LOU). Målet med uppsatsen är att belysa hur ekonomiska krav i offentlig upphandling kan påverka entreprenadprojekt och hur försäkringsskyddet förhåller sig till entreprenörens ansvar i förhållande till en konkurs.
För att uppnå detta syfte har en rättsdogmatisk metod använts för att fastställa gällande rätt, kombinerad med en jämförande analys av försäkringsvillkor från två försäkringsbolag. För att uppnå detta syfte har en rättsdogmatisk metod använts för att fastställa gällande rätt, kombinerad med en jämförande analys av försäkringsvillkor från två försäkringsbolag. Uppsatsen undersöker bland annat vilka krav som kan ställas på entreprenörens ekonomiska ställning inom ramen för offentlig upphandling, i vilken utsträckning fullgörandeförsäkringar täcker entreprenörens ansvar enligt AB 04 och ABT 06 samt vilka konsekvenser som uppstår när försäkringen inte fullt ut täcker de krav som avtal och lag ställer.
Analysen visar att fullgörandeförsäkringar erbjuder en viktig ekonomisk trygghet för beställaren, men att vad en sådan försäkring täcker varierar beroende på vilket försäkringsbolag som används. Exempelvis har vissa försäkringar begränsningar vad gäller kostnader för ÄTA-arbeten och förseningar. Detta kan skapa osäkerheter och potentiella problem för beställaren, särskilt vid entreprenörens konkurs. Vidare framgår att upphandlande myndigheter har frihet att bedöma om en fullgörandeförsäkring är tillräcklig som bevis på ekonomisk ställning men att kraven måste vara proportionerliga och förenliga med upphandlingsrättsliga principer.
Målet med uppsatsen är att bidra till en ökad förståelse för hur de tre rättsområdena överlappar och samspelar med varandra. I uppsatsen konstateras också att det finns behov av tydligare reglering och bättre anpassning mellan försäkringsskydd och de krav som ställs i entreprenadavtal och offentlig upphandling. The aim is to highlight how economic requirements in public procurement can impact construction projects and how insurance coverage relates to the contractor's responsibilities, particularly in cases of bankruptcy.
AB 04 and ABT 06 are widely used standard agreements in Sweden's construction industry. AB 04 applies to contracts where the client is responsible for design, while ABT 06 is designed for turnkey contracts where the contractor undertakes both design and execution. These agreements establish rules for the allocation of responsibility, liability for defects, and rights to compensation during and after the construction process. The Swedish Public Procurement Act (LOU), which is based on EU public procurement directives, governs how public authorities acquire goods, services, and works and includes principles such as proportionality, equal treatment, and transparency.
To achieve the thesis’ objectives, a traditional legal dogmatic method was used to determine the applicable law, combined with a comparative analysis of insurance terms from two insurance providers. The thesis examines, among other things, the economic requirements that can be imposed on contractors, the extent to which performance bonds cover contractor liabilities under AB 04 and ABT 06, and the consequences that arise when the insurance does not fully cover the requirements set by agreements and legislation.
The analysis reveals that performance bonds provide significant financial security for clients but that their coverage varies depending on the specific

terms of the insurance. For instance, some insurances have limitations concerning costs for ÄTA works (a Swedish term for Changes, Additions, and Deductions) and delays. These limitations can create uncertainties and potential risks for clients, particularly in cases of contractor bankruptcy. Furthermore, the analysis shows that contracting authorities have the discretion to determine whether a performance bond sufficiently demonstrates financial capacity, though such requirements must adhere to the principles of proportionality and fairness inherent in public procurement law.
The thesis aims to contribute to a greater understanding of how these three legal areas overlap and interact while also identifying the need for clearer regulation and better alignment between insurance coverage and the requirements set forth in construction contracts and public procurement processes.
