- Abstract
- The United Nations Convention on the Rights of the Child (CRC) has been in force as law since 1 January 2020 in Sweden. Soon after, something called the "LVU-campaign" was launched, and other actors who demonstrate against the social welfare board's decision on forced care of children have recently also received a lot of attention. I am therefore curious about whether the incorporation of the CRC has affected the Swedish Care of Young Persons Act (SFS 1990:52), abbreviated LVU, in a way that causes more children to receive care. - The United Nations Convention on the Rights of the Child (CRC) has been in force as law since 1 January 2020 in Sweden. Soon after, something called the "LVU-campaign" was launched, and other actors who demonstrate against the social welfare board's decision on forced care of children have recently also received a lot of attention. I am therefore curious about whether the incorporation of the CRC has affected the Swedish Care of Young Persons Act (SFS 1990:52), abbreviated LVU, in a way that causes more children to receive care. Therefore, the purpose of the essay has been to examine how LVU, both the legislation itself and the cases, have been affected by the incorporation of the CRC. This is done through a legal dogmatic and legal-analytical method by studying preparatory work, doc-trine and legal cases from different instances.
The essay's conclusion is that the incorporation affected the LVU mainly in such a way that the legislator points out the position of the CRC as law in preparatory work for changes in the LVU that were added after the incorpo-ration. However, the incorporation does not seem to have had full effect with the courts yet, as they rarely make their own assessment of e.g. best interests of children. Continued work is therefore needed, which was also pointed out by the National Audit Office.
Finally, there are many more rights under the CRC that are not mentioned at all in the courts' judgments. An increased opportunity for children to be able to complain when decisions affecting them have violated their rights could possibly give a positive development to this problem. Uppsatsens slutsats är att inkorporeringen påverkat LVU främst på så sätt att lagstiftaren påpekar barnkonventionens ställning som lag i förarbeten till ändringar i LVU som tillkommit efter inkorporeringen. Däremot verkar inkorporeringen inte gett full effekt hos domstolarna än, eftersom de sällan gör en egen bedömning av t.ex. barns bästa. Ett fortsatt arbete behövs alltså, vilket också påpekats av riksrevisionen.
Slutligen finns många fler rättigheter enligt barnkonventionen som inte alls nämnts i domstolarnas domar. En ökad möjlighet för barn att kunna klaga när beslut som rör dem kränkt deras rättigheter kan möjligtvis ge en positiv utveckling på detta problem. (Less)
