Sammanfattning
Inom konkursrätt kan vara av intresse för ett konkursbo att låta viss egendom utgå ur konkursboet i syfte att ge så god utdelning som möjligt till borgenärerna. Till exempel i de fall att egendomen är befäst med olika utgifter som kan bidra till att konkursboet får en minskad nettovinst. Genom NJA 2004 s. 777 har abandonering ansetts vara tillåtet i svensk rätt och det har sedan dess behandlats i många olika rättsprejudikat. I vissa av rättsprejudikaten har abandonering också behandlats i förhållande till miljöansvar. Sedan tidigare har detta förhållande avhandlats genom olika tillägg i rättsprejudicerande domar med olika doktrin. I andra rättssystem finns abandoneringsinstitut kodifierat.

Till exempel i de fall att egendomen är befäst med olika utgifter som kan bidra till att konkursboet får en minskad nettovinst. Genom NJA 2004 s. 777 har abandonering ansetts vara tillåtet i svensk rätt och det har sedan dess behandlats i många olika rättsprejudikat. I vissa av rättsprejudikaten har abandonering också behandlats i förhållande till miljöansvar. Sedan tidigare har detta förhållande avhandlats genom olika tillägg i rättsprejudicerande domar med olika doktrin. I andra rättssystem finns abandoneringsinstitut kodifierat.
Uppsatsen syftar till att med rättsdogmatisk metod utreda hur abandonering av egendom i konkursrätten förhåller sig till miljöansvaret, samt att utreda hur en eventuell framtida reglering kan utformas för att vidare bejaka konkursrättsliga och miljörättsliga syften. De olika tillägg som förekommer i de rättsprejudicerande domarna har jämförts mot nu gällande rätt och utgjort en del i bedömningen av hur framtida lag skulle kunna utformas.
Enligt rådande miljörättspraxis kan konkursbo omfattas av massaansvar i samband med att det tar över rådigheten över miljöfarligt avfall.
Utredningen når slutsatsen att abandonering av egendom i nu gällande rätt inte verkar ha några egentliga verkningar gentemot miljöansvaret och att beträffande lämplig framtida rätt bör detta förhållande fortsätta. Däremot kan det enligt analysen finnas intresse i förhållande till både miljörättsliga och konkursrättsliga syften att göra ovan beskrivna miljöansvar gällande i konkursen istället, samt vidare befästa fordringar hänförliga till miljöansvar med förmånsrätt enligt Förmånsrättslag (1970:979) (Less)

In swedish bankruptcy law, it may be in the interest of a bankruptcy estate have certain property in the bankruptcy assets removed to provide the best possible gain for the creditors. For instance, in certain cases the property may be secured with various expenses that may contribute to the bankruptcy estate receiving a reduced net profit. Through the legal precedent NJA 2004 s. 777, abandonering, i.e. ‘abandonment of property’ is considered permissible in Swedish law. It has since been further advanced upon in different legal precedents. In some of these, abandonment of property has also been dealt with in relation to environmental law and environmental liability. Summary
In swedish bankruptcy law, it may be in the interest of a bankruptcy estate have certain property in the bankruptcy assets removed to provide the best possible gain for the creditors. For instance, in certain cases the property may be secured with various expenses that may contribute to the bankruptcy estate receiving a reduced net profit. Through the legal precedent NJA 2004 s. 777, abandonering, i.e. ‘abandonment of property’ is considered permissible in Swedish law. It has since been further advanced upon in different legal precedents. In some of these, abandonment of property has also been dealt with in relation to environmental law and environmental liability. In some of these precedents, the concept has also been discussed further through different non-preceding supplementary comments. In other legal systems, abandonment of property has been codified, or explicitly written into laws.
The goal of this essay is to further investigate how abandonment of property within the realms of bankruptcy law relates to environmental liability and to try to assess how a possible future regulation could be designed to affirm the purposes of both bankruptcy, and environmental law purposes. The different supplementary additions to the precedential judgements have been compared with current applicable law and have formed a vital part of the assessment of how future regulations could possibly be formed.
According to current environmental law, a bankruptcy estate itself can be subject to liability, in direct connection with taking over the ownership of environmentally hazardous waste.
The essay concludes that abandonment of property does not appear to have any real effects on environmental liability under current law, and that this should in fact be applicable for potential future law as well. However, ac-cording to analysis something should be changed about the way liability is subjected directly to the estate and this should be leading with or without abandonment. A possible solution is that all environmental liability pertaining to the taking over of the ownership of environmentally hazardous waste instead be made part of the bankruptcy with certain preferential rights over other liabilities. This would be preferable both in terms of bankruptcy law and environmental law. (Less)
