Överskjutande likgiltighet? - En undersökning av hur likgiltighetsuppsåtet används som överskjutande uppsåt

En vanlig skiljelinje mellan det kriminaliserade och icke-kriminaliserade området dras vid uppsåtets nedre gräns, då en grundförutsättning är att brott kräver uppsåt. Uppsåt och straffbarhet relaterar inte enbart till varandra på ovan nämnda vis. Vid brottsformer såsom försök, förberedelse och stämpling uppställs krav på att gärningspersonen som en del av brottsrekvisiten ska ha haft uppsåt att nå längre med sin gärning än vad som blev fallet. Uppsatsen ämnar därför att granska hur likgiltighetsuppsåtet används i situationer med överskjutande uppsåt, särskilt inriktad på osjälvständiga brottsformer.

Detta sker genom att stegvis introducera och presentera aspekter av likgiltighet och uppsåtsbegreppet som sådant samt de utmärkande kraven för de aktuella brottsformerna. Med grund i detta går det att slutligen jämföra de två huvudområdena i syfte att se eventuella konflikter i regleringarnas ändamål och användningsområden. (Less)

A common dividing line between the criminalized and non-criminalized area is drawn at the lower limit of intent, as a basic requirement is that crime requires intent. Intent and criminality do not only relate to each other in the above-mentioned way. In the case of dependent forms of crime such as attempt, preparation and conspiracy, a requirement is made that the perpetrator, as part of the requisites of the crime, must have intended to go further with his deed than was the case. The essay therefore intends to examine how the intention of indifference is used in situations with excessive intent, particularly focused on dependent forms of crime.

A common dividing line between the criminalized and non-criminalized area is drawn at the lower limit of intent, as a basic requirement is that crime requires intent. Intent and criminality do not only relate to each other in the above-mentioned way. In the case of dependent forms of crime such as attempt, preparation and conspiracy, a requirement is made that the perpetrator, as part of the requisites of the crime, must have intended to go further with his deed than was the case. The essay therefore intends to examine how the intention of indifference is used in situations with excessive intent, particularly focused on dependent forms of crime.

This is done by gradually introducing and presenting aspects of indifference and the concept of intent as such, as well as the distinguishing requirements for the current forms of crime. Based on this, it is possible to compare the two main areas in order to see any conflicts in the purposes and areas of use of the regulations.

The author draws the conclusion that attempt, preparation and conspiracy impose requirements that an act must have a direction towards an effect and that linguistic and theoretical objections can be made to the expansion of the scope of indifference. The author establishes that the intention of indifference is not adapted to be applied to dependent forms of crime. As an alternative form of intent, probable intent is presented, which has seen use in other Nordic countries and is otherwise similar to the intent of indifference. (Less)
