Abstract
The Convention on the Rights of the Child was incorporated into Swedish law in 2020 to strengthen children's social rights. Since its incorporation, researchers have investigated how the Convention has affected work with children's rights. There are still knowledge gaps on how to interpret these principles. This study aims to understand how the child's best interests, the child's opinion, health and development, and age and maturity are presented in 10 judgments from the Swedish Court of Appeals at LVU. The Convention on the Rights of the Child was incorporated into Swedish law in 2020 to strengthen children's social rights. Since its incorporation, researchers have investigated how the Convention has affected work with children's rights. There are still knowledge gaps on how to interpret these principles. This study aims to understand how the child's best interests, the child's opinion, health and development, and age and maturity are presented in 10 judgments from the Swedish Court of Appeals at LVU. LVU cases are when children are taken into compulsory care due to tangible problems in the family or with the children. This essay is based on a sociological method of law and has content analysis as an analysis method. The essay is also based on two different theories: the sociology of law and the sociology of childhood. The essay's results show that the child's best interests are often presented in formality about the law. There are rarely discussions about the specific child, with a written justification for why the decision has been made. Society's values ​​and standards were reflected in the discussion about the child's opinion, health, and development. The results also showed that the children were portrayed as children needing care and protection. The child's health and development also received the most space in assessing the selected concepts. This was shown due to the court´s constant reference to health and development. The child's maturity and age showed that they were often assigned a passive role due to their age. This result was reflected no matter the child's age. (Less)
