Abstract
The Swedish form of discrimination, lack of accessibility, is unique. To an extent, this form of discrimination requires the employer to adapt the work of a disabled person, who needs special accommodation, intending to put the individual in a comparable situation to his co-workers. This form of discrimination has a close connection to indirect discrimination. Often, these are invoked in combination with each other. In some countries, the close connection between them has resulted in the law regulating only one of the two forms of discrimination. The Swedish form of discrimination, lack of accessibility, is unique. To an extent, this form of discrimination requires the employer to adapt the work of a disabled person, who needs special accommodation, intending to put the individual in a comparable situation to his co-workers. This form of discrimination has a close connection to indirect discrimination. Often, these are invoked in combination with each other. In some countries, the close connection between them has resulted in the law regulating only one of the two forms of discrimination. By employing the legal dogmatic method, the relationship between these laws has been clarified, considering their legal requisites, similarities, differences, and respective applications in court practice.
Lack of accessibility is based on the obligation of the employer to apply reasonable adaptation to the workplace. These should make it possible for disabled people to reach a comparable situation with people without such disabilities. Indirect discrimination is about how a rule or procedure, which is seemingly neutral, leads to a special disadvantage to a certain group, for example, disabled people. By analyzing cases from Arbetsdomstolen, and applying a legal dogmatic analysis, both conceptual and functional differences between the forms of discrimination arise. The essay shows that the forms of discrimination overlap to a certain extent, but simultaneously are distinct in regards to evaluating the actions of the employer. Lack of accessibility requires discrimination based on the passivity of the employer, meanwhile, indirect discrimination requires active action through applying discriminatory rules or procedures. By going through cases and other legal frameworks, the essay illustrates the legal and practical difficulties in applying the forms of discrimination. The essay established that both lack of accessibility, and indirect discrimination, are important tools to ensure protection for people with disabilities in working life. (Less)

Indirekt diskriminering handlar däremot om hur en regel eller förfarande, som till synes är neutral, leder till särskilt missgynnande av en viss grupp, såsom personer med funktionsnedsättning. Genom att analysera praxis från Arbetsdomstolen, samt tillämpa en rättsdogmatisk analys, framträder såväl konceptuella som funktionella skillnader mellan dessa diskrimineringsgrunder. Uppsatsen visar att diskrimineringsformerna överlappar i viss utsträckning, men samtidigt är distinkta i fråga om hur arbetsgivarens agerande bedöms. Vid bristande tillgänglighet utgörs diskrimineringen av arbetsgivarens passivitet, eller underlåtenhet, medan indirekt diskriminering förutsätter ett aktivt handlande genom tillämpning av diskriminerande regler eller förfaranden. Genom att undersöka praxis och rättsliga ramverk belyser uppsatsen de rättsliga och praktiska utmaningar vid tillämpningen av dessa diskrimineringsformer. Uppsatsen konstaterar att både bristande tillgänglighet och indirekt diskriminering är viktiga verktyg för att säkerställa skydd för personer med funktionsnedsättning i arbetslivet. (Less)
