- This essay investigates the risk of corruption in public procurement with a focus on bribery. What are the risk factors that contribute to vulnerabilities in public procurement that could lead to corruption and the essay explains how the procurement legislation is designed to counteract bribery in public authorities.
Corruption is not a new phenomenon in public procurement. There has always been an inherent risk associated with the procurement processes. Corruption has a profoundly negative impact on society, that can consequently reduce the citizens trust in the authorities. Corruption is not a new phenomenon in public procurement. There has always been an inherent risk associated with the procurement processes. Corruption has a profoundly negative impact on society, that can consequently reduce the citizens trust in the authorities. The essay describes the difficulties in applying the practice that exists in the field and where to draw the line when it’s becoming an undue advantage. With the help of case law from the Supreme Court, it will be investigated how they have ruled in cases of bribery in public procurement.
This is supplemented by the authorities view of the situation and what should be done. Bribery in public procurement currently lacks significant precedent from the Supreme Court or substantial academic doctrine, leading to uncertainty about what rules are applicable. There are authorities such as the Swedish Competition Authority and the procurement authority which monitors the market and sharing their knowledge about risks of corruption. Authorities and other publicly governed bodies have a responsibility to do what is best for the society.
The Public Procurement Act (LOU) is the regulatory framework that governs how a procurement should be carried out. In public procurement, the procuring authority maintain close contact with suppliers to ensure that the purpose of the procurement is carried out and maintain a competitive market. Det kommer med hjälp av rättspraxis från Högsta domstolen undersökas hur de har dömt vid mutbrott under offentlig upphandling.
Detta kompletteras med hur våra myndigheter ser på situationen och vad som bör göras. Mutbrott inom den offentliga upphandlingen har idag inte särskilt mycket praxis från Högsta domstolen eller doktriner vilket leder till osäkerhet om vilka regler som är tillämpliga. Det finns myndigheter som Konkurrensverket och upphandlingsmyndigheten som arbetar med att övervaka marknaden och att sprida kunskap kring risker för korruption. Myndigheter och andra offentligt styrda organ har ett ansvar att göra det som är rätt för samhället.
Lagen om offentlig upphandlingen (LOU) är det regelverk som styr hur en upphandling ska gå till. Vid offentliga upphandlingar har den upphandlande myndigheten täta kontakter med leverantörer för att säkerställa att syftet med upphandlingen uppnås och att det fortfarande finns en konkurrensutsatt marknad.
