- Abstract
- This study examines the legal and ethical dilemmas within compulsory institutional care at the Swedish National Board of Institutional Care (SiS). The research problem is based on the extensive criticism directed at SiS institutions, where deficiencies in legal certainty, treatment methods, and the rights of youths have been identified. The study focuses on how the exercise of power affects both staff discretion and the experiences of the youth in care. The aim is to analyze these challenges and explore opportunities to strengthen legal certainty and the ethical foundation of compulsory institutional care. - This study examines the legal and ethical dilemmas within compulsory institutional care at the Swedish National Board of Institutional Care (SiS). The research problem is based on the extensive criticism directed at SiS institutions, where deficiencies in legal certainty, treatment methods, and the rights of youths have been identified. This qualitative study is based on semi-structured interviews with staff at a SiS institution. The interviews were thematically analyzed to identify patterns in the staff’s experiences and reflections. The findings indicate that staff often experience a conflict between legal requirements and ethical considerations. The power dynamics within compulsory institutional care create a problematic balance between control and care. The study underscores the need for increased legal certainty, enhanced youth participation, and improved aftercare to make compulsory institutional care more legally secure and effective. (Less)
