- Med hjälp av artificiell intelligens är det idag möjligt att skapa verklighetstrogna bilder och filmer som föreställer sådant som aldrig har hänt, så kallade deepfakes. Tekniken används i stor utsträckning för att sprida fejkade pornografiska bilder och filmer av enskilda personer, vilket kränker den sexuella integriteten hos den avbildade. Medan vem som helst kan utsättas för denna typ av kränkning är det i första hand kvinnor som drabbas. - Med hjälp av artificiell intelligens är det idag möjligt att skapa verklighetstrogna bilder och filmer som föreställer sådant som aldrig har hänt, så kallade deepfakes. Tekniken används i stor utsträckning för att sprida fejkade pornografiska bilder och filmer av enskilda personer, vilket kränker den sexuella integriteten hos den avbildade. Medan vem som helst kan utsättas för denna typ av kränkning är det i första hand kvinnor som drabbas. Detta arbete undersöker den rådande straffrättsliga regleringen för att se om och hur den hanterar framställandet och spridandet av pornografiska deepfakes. Arbetet undersöker vidare hur straffrättslig reglering samspelar med övrig reglering av olagligt material på internet för att motverka otillåten spridning. Uppsatsen ser på pornografiska deepfakes som en kränkning av den sexuella integriteten och lutar sig mot tidigare forskning kring bildbaserade sexuella övergrepp för att sätta pornografiska deepfakes i en kontext av könat våld.
Arbetet finner att varken framställandet eller spridandet av pornografiska deepfakes är kriminaliserade handlingar i svensk gällande rätt. Detta leder till att skyddet för den personliga integriteten i det svenska straffrättsliga systemet inte är koherent, och inte på ett adekvat sätt tar hänsyn till vidden av möjliga kränkningar av den sexuella integriteten. I arbetet argumenterar jag därför för att såväl framställandet som spridandet av pornografiska deepfakes bör kriminaliseras och föreslår ett övergripande ramverk för hur denna straffrättsliga reglering bör se ut. I mitt förslag lutar jag mig mot vad forskning om bildbaserade sexuella övergrepp säger om skadeverkan för och motivbilden bakom spridandet av pornografiska deepfakes för att argumentera för hur bestämmelserna bör se ut för att säkerställa ett skydd som stämmer överens med det övriga skyddet för den personliga integriteten och som tar hänsyn till den tekniska utvecklingen. This essay examines to what extent the Swedish criminal justice system is equipped to address the creation and distribution of pornographic deepfakes. Further, the essay examines how the criminal justice system cooperates with other legislation concerning illegal material on the internet to combat unlawful distribution of images.... The essay views pornographic deepfakes as a violation of sexual integrity and draws from previous research on image-based sexual abuse to contextualise pornographic deepfakes as gender-based violence.
The essay finds that neither the creation nor the distribution of pornographic deepfakes are criminalised actions under Swedish law. This renders the protection of personal integrity in the Swedish criminal justice system incoherent and inadequate in relation to the extent of possible violations of sexual integrity. In the essay, I therefore argue that both the creation and the distribution of pornographic images should be criminalised. I further suggest a general framework for what this legislation should look like. In my proposal I lean on previous research regarding image-based sexual abuse and its conclusions about its harms and motivations to argue what legislation should look like to guarantee protection for personal integrity that is coherent and up to date with current technological advancements.
