Uppsatsen syftar till att granska fri- och rättighetskommitténs syfte och ända
mål med lagförslaget i betänkandet SOU 2025 Några frågor om grundläg
gande fri- och rättigheter, samt vilka konsekvenser som det eventuellt kan
medföra. Lagförslaget innebär en grundlagsändring av 2 kap. 7 § Regerings
formen som stadgar en absolut rätt att som svensk medborgare inte landsför
visas samt att inte fråntas sitt medborgarskap. Förbudet mot ett fråntagande
av svenskt medborgarskap grundar sig i syftet att inte kunna kringgå förbudet
mot landsförvisning. Förslaget är uppdelat i två delar: dels att ett medborgar
skap ska kunna fråntas den som förvärvat ett svenskt medborgarskap genom

Uppsatsen syftar till att granska fri- och rättighetskommitténs syfte och ända
mål med lagförslaget i betänkandet SOU 2025 Några frågor om grundläg
gande fri- och rättigheter, samt vilka konsekvenser som det eventuellt kan
medföra. Lagförslaget innebär en grundlagsändring av 2 kap. 7 § Regerings

som begått viss allvarlig brottslighet. Arbetet behandlar endast den senare de
len av frågan. Vilken typ av brottslighet som ska omfattas av den förslagna
regleringen lämnar kommittén till lagstiftaren att bedöma, men att det åt
minstone bör gälla 18, 19 och 22 kap. Brottsbalken. Enligt kommittén bör
lagförslaget vara tillämpbart på samtliga förvärv av medborgarskap men end
ast för de som har dubbelt medborgarskap. Detta för att undvika statslöshet.
För att underlätta granskningen inleds arbetet med att utreda gällande rätt,
både nationell och internationell. Arbetet har därmed skrivits utifrån den rätts
dogmatiska metoden. Arbetet innehåller även en tillbakablickande del där
syftet är att utreda hur man tidigare resonerat i utrednings- och lagstiftnings
ärenden gällande frågan om fråntagande av svenskt medborgarskap. I samt
liga ärenden var slutsatsen att det inte fanns tillräckligt starka skäl för att in
föra en möjlighet till fråntagande. Då det i svensk rätt inte tidigare funnits en
fråntagandemöjlighet har dansk rätt granskat då den danska rättsordningen i
många avseenden är lik den svenska samt att Danmark har en lagstadgad möj
lighet att frånta en enskild sitt danska medborgarskap på grund av brottslig
het. Den komparativa metoden har därmed tillämpats.
Att bedöma konsekvenser av en lagstiftning som tidigare inte funnits i den
svenska rättsordningen har medfört svårigheter. Inte minst genom att det i
Sverige inte lagras information om vem som har dubbla medborgarskap, vil
ket försvårar att kunna dra en slutsats utifrån svensk praxis vad utfallet skulle
bli om det fanns en möjlighet till ett fråntagande. Konsekvensanalysen har
därmed utgått från praxis av Europadomstolen, EU-domstolen och dansk lag
stiftning. Utifrån praxis samt resonemang från tidigare utrednings- och lag
stiftningsärenden, från reservationer i betänkandet och remissyttranden, är
slutsatsen av min analys att lagförslaget kan medföra konsekvenser för integ
rationen, synen på medborgarskapet, förtroendet för rättsordningen samt fa
miljerättsliga konsekvenser. (Less)

The purpose of this thesis is to examine the objectives and aims of the Com
mittee in its legislative proposal presented in the Report SOU 2025:2 Some
Issues Concerning Fundamental Rights and Freedoms, as well as the potential
consequences that may accure from the proposal. The proposal entails a con
stitutional amendment to Chapter 2, Paragraph 7 of the Instrument of Gov
ernment, which establishes an absolute right for Swedish citizens to stay in
the country and not to be deprived of their citizenship. The prohibition against
revoking Swedish citizenship is rooted in the objective of preventing any cir

The purpose of this thesis is to examine the objectives and aims of the Com
mittee in its legislative proposal presented in the Report SOU 2025:2 Some
Issues Concerning Fundamental Rights and Freedoms, as well as the potential
consequences that may accure from the proposal. The proposal entails a con
stitutional amendment to Chapter 2, Paragraph 7 of the Instrument of Gov
ernment, which establishes an absolute right for Swedish citizens to stay in
the country and not to be deprived of their citizenship. The prohibition against
revoking Swedish citizenship is rooted in the objective of preventing any cir
cumvention of the prohibition on expulsion. The proposal is divided into two
parts: first, the possibility of revoking citizenship obtained through false or
incomplete information or other improper conduct; and second, revocation
based on certain serious criminal offences. This thesis addresses only the lat
ter part. The Committee leaves it to the legislator to determine which types of
criminal offences that should fall within the scope of the proposed regulation
but suggests that at least chapters 18, 19, and 22 of the Swedish Penal Code
should apply. According to the Committee, the proposed law should apply to
all acquisitions of Swedish citizenship but only to individuals who hold dual
citizenship in order to avoid statelessness.
To facilitate the examination, the thesis begins by investigating the applicable
legal framework, both national and international. The thesis is therefore based
on the legal-dogmatic method. It also includes a historical section aimed at
exploring how the issue of revocation of Swedish citizenship has previously
been addressed in legislative and preparatory work. In all previous cases, the
conclusion was that there were not sufficient grounds to introduce a possibil
ity for revocation. Since Swedish law has not previously allowed for such a
measure, Danish law has been examined due to its structural similarity to the
Swedish legal system and the fact that Denmark has a statutory provision al
lowing for the revocation of Danish citizenship on grounds of criminal con
duct. Thus, a comparative method has also been applied.
Assessing the potential consequences of a legal regulation that has not previ
ously existed within the Swedish legal system has presented challenges. Not
least due to the fact that Sweden does not store information regarding indi
viduals dual citizenship, which complicates drawing conclusions from Swe
dish cases as to the likely outcomes of such a legal change. The consequence
analysis has therefore been based on cases of the European Court of Human
Rights, the Court of Justice of the European Union, and relevant Danish leg
islation.
Based on legal precedents, previous inquiries and legislative proposals, dis
senting opinions within the Committee’s report, and responses from the re
ferral process, the conclusion of my analysis is that the legislative proposal

may entail consequences for integration, perceptions of citizenship, trust in
the legal system, as well as consequences related to family law. (Less)
