Abstract
This thesis examines how national courts within the European Union should assess digital evidence obtained in other Member States, with a particular fo-cus on the controversial EncroChat operation. Using legal dogmatic and com-parative methods, the study explores developments in five EU jurisdictions – Sweden, France, Germany, the Netherlands, and Belgium – to highlight the tension between the principle of mutual recognition and the safeguards of the rule of law under the EU Charter and the European Convention on Human Rights. Denna uppsats analyserar hur nationella domstolar inom EU bör hantera digi-tal bevisning som inhämtats i andra medlemsstater, med särskilt fokus på den kontroversiella EncroChat-operationen. Genom rättsdogmatisk och kompara-tiv metod granskas rättsutvecklingen i fem EU-länder – Sverige, Frankrike, Tyskland, Nederländerna och Belgien – för att belysa spänningen mellan det ömsesidiga erkännandets krav och rättssäkerhetsprincipens garantier enligt EU-stadgan och Europakonventionen.
