EU-rättens federalism: En analys av AMLR och AMLA-förordningen

Abstract
Over the past 30 years EU law has shifted from being based on intergovernmental agreements where sovereign states are at the centre, to a more unified and supranational legal system. This supranational legal system is similar to systems found in federal states. In the area of anti-money laundering and countering the financing of terrorism, the EU has adopted a comprehensive and detailed legislative package that Member States must implement. By analyzing this legislative package, the essay will show how the EU and EU law are considered to have attributes and characteristics that exist in federal legal systems. Consequently, the essay will also argue that the EU and EU law are on the way to be developed into a federalistic legal system.

Under de senaste 30 åren har EU-rätten skiftat från att vara baserad på mellanstatliga avtal där suveräna stater är i centrum till en mer enhetlig och överstatlig rättssystem. Detta överstatliga rättssystem liknar ett system som finns i federala stater. Inom området bekämpningen av penningtvätt och finansiering av terrorism har EU stiftat ett omfattande, detaljerad och ingående lagstiftningspaket som medlemsstaterna måste implementera. Genom att analysera detta lagstiftningspaket kommer uppsatsen att visa hur EU och EU-rätten anses ha attribut och kännetecken som finns i federala rättssystem. Följaktligen kommer uppsatsen även att redogöra och argumentera att EU och EU-rätten är på väg att utvecklas till ett federalistiskt rättssystem.
