- Abstract
- This thesis examines the implementation of juries in Sweden during the first half of the eighteenth century. Juries were implemented in cases regarding breaches of the press law in 1815, but never in general courts. How the latter came to be tends to be inserted into a larger discussion regarding the so-called codification battles between liberal actors and representatives of the German historical school of jurisprudence during the first decades of the eighteenth century. - This thesis examines the implementation of juries in Sweden during the first half of the eighteenth century. Juries were implemented in cases regarding breaches of the press law in 1815, but never in general courts. How the latter came to be tends to be inserted into a larger discussion regarding the so-called codification battles between liberal actors and representatives of the German historical school of jurisprudence during the first decades of the eighteenth century. This does not mean that the debate regarding the implementation of juries has not been treated academically, but these do not appear to be examined with the same amount of detail as the codification battles. Therefore, this thesis is positioned in a place that is aimed at merging prior research into a deeper understanding.
The method applied in the thesis is heavily inspired by the influential article Meaning and understanding in the history of ideas, written by the political scientist Quentin Skinner. This means that the thesis at hand strives to reach a deeper historical understanding of the thinking of the past. Practically, this implies that the thesis examines different factors, ranging from studies of actors to examinations of past context in order to investigate how the ideas were formed. Through this method, the purpose of the thesis is to present prior research in a new light and produce new conclusions.
The thesis produces three conclusions. The first is that it is not necessarily right to depict the jury debate as a dichotomy between conservatives and liberals. The second is that said discussion seems to be about competing conceptions of liberty and how this is best achieved. Finally, the object of study can serve to illustrate a transition in legal thought from natural law to an instrumental view of law. (Less) - Abstract (Swedish)

Praktiskt innebär detta att uppsatsen undersö-ker olika faktorer, däribland aktörer och dåtidens kontext för att undersöka hur idéerna kunde formas. Genom denna metod är uppsatsens syfte att pro-ducera nya slutsatser och placera tidigare forskning i ett nytt ljus.
Uppsatsen kommer fram till tre slutsatser. Den första slutsatsen är att det inte nödvändigtvis är rätt att framställa diskussionerna gällande juryns införande som en dikotomi mellan konservativa och liberaler. Den andra slutsatsen är att diskussionen verkar handla om tävlande uppfattningar om konceptet frihet och hur denna uppnås på bästa sätt. Den sista slutsatsen är att uppsatsens studieobjekt kan illustrera en övergång i juridiskt tänkande från naturrätt till en instrumentell syn på rätten. (Less)
