- Den 15 januari 2025 lämnade Fri- och rättighetskommittén fram betänkandet SOU 2025:2, med ett förslag som gör det möjligt att återkalla svenskt medborgarskap om det har förvärvats på otillbörligt sätt eller om personen har dömts för särskilt allvarlig brottslighet. För att undvika statslöshet ska återkallelsen endast kunna ske för personer med dubbelt medborgarskap. Eftersom denna grupp ofta består av personer med utländsk bakgrund uppstår frågan om regleringen riskerar att leda till indirekt diskriminering.

Mot denna bakgrund analyserar uppsatsen om den förslagna återkallelseregleringen av svenskt medborgarskap är förenligt med diskrimineringsförbudet i 2 kap. 12 § regeringsformen. Analysen bygger på rättsdogmatisk metod och utgår från lagtext, förarbeten, praxis och doktrin.
Bedömningen utgår från den modell för diskrimineringsprövning som erkänts i svensk rätt och som utvecklats i Europadomstolens praxis. Den innebär att det först prövas om de berörda grupperna befinner sig i en jämförbar situation och om det föreligger en skillnad i behandling. Därefter bedöms om denna skillnad har ett samband med en skyddad diskrimineringsgrund och slutligen om särbehandlingen kan rättfärdigas genom objektivt godtagbara och proportionerliga skäl.
Analysen har lett fram till följande slutsats. Enkel- och dubbelmedborgare har samma rättsliga status och befinner sig i en jämförbar situation. Förslaget innebär att endast den ena gruppen riskerar att förlora sitt medborgarskap, vilket utgör en skillnad i behandling av en grundläggande rättighet. Eftersom dubbelmedborgarskap i stor utsträckning förekommer bland personer med utländsk bakgrund uppstår en risk för indirekt diskriminering på grund av etniskt ursprung. Vid en prövning av om särbehandlingen kan motiveras utifrån objektivt godtagbara och proportionerliga skäl framstår förslaget som oförenligt med 2 kap. 12 § regeringsformen. (Less) - Abstract
- On 15 January 2025, the Committee on Fundamental Rights presented the report SOU 2025:2, which includes a proposal enabling the revocation of Swedish citizenship if it is acquired through improper means or if the individual has been convicted of particularly serious crimes. To avoid statelessness, revocation would only be possible for individuals with dual citizenship. Since this group often consists of persons with foreign background, the question arises whether the proposed regulation risks resulting in indirect discrimination.
Against this background, the thesis analyses whether the proposed revocation scheme for Swedish citizenship is compatible with the prohibition of discrimination in Chapter 2, Section 12 of the Swedish... The analysis is based on a legal dogmatic approach, involving an examination of laws, preparatory works, case law and doctrine.
The assessment follows the model for discrimination review recognized in Swedish law and developed in the case law of the European Court of Human Rights. According to this model, the analysis begins by examining whether the affected groups are in a comparable situation and whether a difference in treatment exists. It then assesses whether this difference is linked to a protected ground of discrimination, and finally whether the differential treatment can be justified by objectively accepted and proportionate reasons.
The analysis has led to the following conclusion. Individuals with single and dual citizenship share the same legal status and are in a comparable situation. The proposal entails that only one group risks losing their citizenship, which constitutes differential treatment in relation to fundamental rights. Since dual citizenship is common among people with foreign backgrounds, the proposal risks indirect discrimination based on ethnic origin. It does not seem justified by objectively acceptable and proportionate reasons, making it incompatible with Chapter 2, Section 12 of the Swedish Constitution. (Less)
