- Abstract
- This paper undertakes an examination of the concept of international law of jurisdiction to assess the extent to which the Corporate Sustainability Due Diligence Directive (CSDDD) aligns with the principle of territoriality. Since international jurisdiction is based on customary principles, the paper explores the traditional concept of international jurisdiction. It highlights the growing recognition of "connections" as a valid basis for exercising prescriptive jurisdiction. The paper further investigates the European Union's approach to territorial extension, referencing the findings of the Court of Justice in the Air Transport Association of America (ATAA) case, which asserts that EU jurisdiction extends beyond its geographic borders.... - This paper undertakes an examination of the concept of international law of jurisdiction to assess the extent to which the Corporate Sustainability Due Diligence Directive (CSDDD) aligns with the principle of territoriality. Since international jurisdiction is based on customary principles, the paper explores the traditional concept of international jurisdiction. It highlights the growing recognition of "connections" as a valid basis for exercising prescriptive jurisdiction. The paper further investigates the European Union's approach to territorial extension, referencing the findings of the Court of Justice in the Air Transport Association of America (ATAA) case, which asserts that EU jurisdiction extends beyond its geographic borders. Drawing on those conclusions, the paper examines the conditions associated with unbounded jurisdiction, particularly in relation to the inputs and outputs of legitimacy, and discusses the implications of these conditions for the CSDDD as well as the role that global value chains play in considerations of public accountability. The discussion highlights the potential negative impacts of transnational human rights law and concludes that while efforts can be made, legitimacy deficits in this area cannot be completely eliminated. - Denna uppsats syftar till att analysera begreppet internationell jurisdiktion i relation till huruvida om CSDDD är förenligt med territorialitetsprincipen. Med utgångspunkt i att internationell jurisdiktion huvudsakligen vilar på folkrättsliga sedvanenormer, inleds framställningen med en genomgång av det traditionella jurisdiktions begreppet. Den diskuterar även vilka implikationer detta har för tillämpningen av CSDDD, samt vilken roll globala värdekedjor spelar i sammanhanget av offentlig ansvarsskyldighet. Avslutningsvis diskuteras potentiella negativa konsekvenser av extraterritoriell människorättslagstiftning, och det konstateras att även om legitimiteten kan stärkas genom rättsliga och institutionella åtgärder, kan den aldrig fullt ut garanteras inom ramen för nuvarande internationell rättslig struktur.
