- Inom den svenska kommersiella entreprenadrätten har AB 04 en dominerande ställning. Standardavtalet är framförhandlat av branschorganisationen BKK. AB 04 innehåller en mängd regler om till exempel ersättning, skadestånd och felansvar. I kapitel sju finns reglerna om slutbesiktning.

I utlåtandet ska besiktningsmannen också ta ställning till godkännandefrågan. Om entreprenaden godkänns är den avlämnad och flera rättsverkningar inträder. Till exempel har entreprenören rätt till slutbetalning och risken för entreprenaden övergår till beställaren.
Men regelverket kring slutbesiktningen i AB 04 är svårtolkad. Det finns många bestämmelser som reglerar slutbesiktningen och innebörden av dem liksom förhållandet dem emellan är oklart. Antalet vägledande avgöranden från HD, utöver själva tolkningsmetoden för AB 04, är fåtaliga. Det finns därmed ett behov av att bringa klarhet i regleringen kring slutbesiktningen i AB 04, inklusive den nomenklatur som används för olika typer av anmärkningar om fel.
Syftet med uppsatsen är således att utreda och kritiskt granska reglerna om slutbesiktning i AB 04. Syftet är också att identifiera vilka juridiska tvistefrågor som slutbesiktningsinstitutet i AB- och ABT-avtalen aktualiserar i underrättspraxis och hur domstolen har besvarat dessa.
För att uppnå det första syftet har jag valt att använda mig av en rättsdogmatisk metod och HD:s tolkningsmetod för AB 04. För att uppnå det andra syftet har jag gjort en rättsfallsundersökning.
Jag kommer fram till att bestämmelserna rörande slutbesiktningen i AB 04 är komplicerad och otydlig. Det finns en hel del generella uttryck vars innebörd är oklar. Dessutom är regleringen formalistisk: Många tidsfrister måste beaktas, olika typer av anmälningar ska göras och det finns en strikt nomenklatur för hur besiktningsutlåtandet bör utformas vad gäller anmärkningar rörande entreprenadens skick.
Avtalsvillkorens tvetydighet kommer till uttryck i rättsfallsundersökningen. Många tvistefrågor rör frågan om en viss avsyning överhuvudtaget utgör en
slutbesiktning enligt AB 04. Genom undersökningen utkristalliserar sig vissa minimikrav som måste vara uppfyllda för att en inspektion ska utgöra en
slutbesiktning i AB 04. En annan återkommande tvistefråga är hur slutbesiktningsutlåtandet ska tolkas, där domstolen fäster stor vikt vid innebörden av olika felanmärkningar och utlåtandets ordalydelse. I flera entreprenadtvister aktualiserades också olika typer av bevisfrågor kopplade till slutbesiktningsutlåtandet.
Uppsatsen konkluderar att den oklara regleringen kring slutbesiktningen enligt AB 04 gör standardavtalet oförutsebart, vilket kan resultera i dyra och tidskrävande tvister. (Less) - Abstract

The final inspection involves an examination of the works’ compliance with the contract, conducted, normally, by an inspector appointed by the employer. The purpose of the final inspection is to determine whether the works is affected by any defects and whether it can be approved or not. Any identified defects are reported in an inspection report. The final inspection involves an examination of the works’ compliance with the contract, conducted, normally, by an inspector appointed by the employer. The purpose of the final inspection is to determine whether the works is affected by any defects and whether it can be approved or not. Any identified defects are reported in an inspection report. In this context, a sector-specific nomenclature has developed within the construction industry for different types of remarks concerning defects. In the report, the inspector must also decide whether the works are approved. If the works are approved several legal effects ensue. For example, the contractor becomes entitled to final payment, and the risk for the works passes to the employer.
However, the regulation of final inspection under AB 04 is difficult to interpret. There are numerous provisions governing the final inspection, and both their individual meaning and their interrelationship are unclear. Apart from the method to interpret AB 04 developed by the Supreme Court, there are only a limited number of guiding precedents. Consequently, there is a need to clarify the regulatory framework governing final inspection under AB 04, including the nomenclature used for different types of defect-related remarks.
The purpose of this thesis is therefore to examine and critically assess the rules on final inspection in AB 04. A further purpose is to identify the legal disputes that the institution of final inspection gives rise to in lower court case law concerning AB and ABT contracts, and to analyze how the courts have
resolved these disputes.
To fulfil the first purpose, a legal dogmatic method has been employed, together with the interpretative method adopted by the Supreme Court in relation to AB 04. To fulfil the second purpose, a case law study has been conducted.
The thesis concludes that the regulation of final inspection in AB 04 is complex and unclear. The provisions contain several general terms whose meaning is uncertain. Moreover, the regulatory framework is highly formalistic: numerous time limits must be observed, various notifications must be made, and there is a strict nomenclature governing how the inspection report should be drafted regarding remarks concerning the condition of the works.
The ambiguity of the regulation is reflected in the case law analysis. Many disputes concern whether a particular inspection at all constitutes a final inspection within the meaning of AB 04. The study identifies certain minimum requirements that must be met for an inspection to qualify as a final inspection
under AB 04. Another recurring issue concerns the interpretation of the final inspection report, where the courts attach significant weight to the meaning of the nomenclature and to the wording of the report. Finally, in several construction disputes various evidentiary issues relating to the final inspection report have also arisen.
The thesis concludes that the unclear regulation of the final inspection under AB 04 renders the standard-form contract inpredictable, which may result in costly and time-consuming disputes. (Less)
