En av grunderna bakom skiljeförfarandet är att skiljedomen med bindande verkan slutligt avgör tvisten mellan parterna. Det är dessutom så att det saknas möjligheter att överklaga en skiljedom på materiella grunder. I lagen (1999:116) om skiljeförfarande (LSF) finns emellertid vissa möjligheter att få en skiljedom undanröjd. Dessa möjligheter stadgas i 33 och 34 §§ LSF. Av 33 § LSF framgår ogiltighetsgrunderna och av 34 § LSF framgår klander-grunderna. I de båda lagrummen finns möjlighet att endast partiellt undanröja skiljedomen.

Den 26 maj 2025 avgjorde Högsta domstolen (HD) två mål som berörde när och under vilka förutsättningar en skiljedom delvis ska ogiltigförklaras re-spektive delvis upphävas. Rättsläget innan avgörandena var osäkert och det saknades vägledning i lagtext, förarbeten och tidigare praxis från HD på när och under vilka förutsättningar detta skulle ske. Uppsatsens syfte är att under-söka avgörandena för att närmare se vad HD kommer fram till och hur en prövning av partiellt undanröjande ska gå till enligt HD. Därtill syftar uppsat-sen att undersöka vilka eventuella konsekvenser som avgörandena kan komma att få och om varför HD väljer den lösning de gör.
Uppsatsen kommer fram till att HD skapar en prövningsordning i två steg. Det första steget är att undersöka om ogiltighets- eller klandergrunden träffar skiljedomen i sin helhet. Om detta inte är fallet ska domstolen gå vidare till nästa steg. Det andra steget består av att pröva om den del av skiljedomen som inte träffas av ogiltighets- eller klandergrunden kan särskiljas från skiljedomen i övrigt och därmed partiellt undanröjas.
De eventuella konsekvenser som kan följa av domarna är att parter i högre grad kommer försöka få skiljedomar partiellt ogiltigförklarade eller partiellt upphävda då de nu vet om under vilka förutsättningar detta ska ske. Dessutom kan avgörandena få betydelse för hur skiljenämnder skriver sina domar och hur parterna lägger fram sin talan. (Less)

One of the core principles underlying arbitration is that the arbitration award, with binding effect, finally resolves the dispute between the parties. In addi-tion, there is no possibility to appeal the arbitration award on material grounds. However, the Swedish Arbitration Act (1999:116) provides certain possibilities for having an arbitrational award set aside. These possibilities are laid down in sections 33 and 34 in the Swedish Arbitration Act. Section 33 sets out the grounds for invalidation and section 34 sets out the grounds for protest. Both sections allow for the partial setting aside of an arbitration award.

These possibilities are laid down in sections 33 and 34 in the Swedish Arbitration Act. Section 33 sets out the grounds for invalidation and section 34 sets out the grounds for protest. Both sections allow for the partial setting aside of an arbitration award.
On 26 May 2025 the Swedish Supreme Court decided two cases concerning when and under which conditions an arbitrational award should be partially invalid or partially set aside. Before these two decisions the legal position was uncertain and there was a lack of guidance in the text of the law, the legislative history and earlier case law. The purpose of this thesis is to examine these decisions to analyse the conclusions reached by the Supreme Court regarding when and under which conditions an arbitration award shall be partially set aside. In addition, the thesis aims to examine the potential consequences of the decisions.
The thesis concludes that the Supreme Court creates a two-step test. The first step consists of deciding whether the ground for invalidity or ground for pro-test affects the arbitration award as a whole. If that is found not to be the case, the court shall move on to the next step. The second step is to examine wheth-er the part that is not affected by the ground for invalidity or ground for pro-test can be separated from the remainder of the arbitration award and thus be partially set aside.
The potential consequences that the thesis finds are that parties may, to a greater extent, seek to have the arbitration award partially invalidated or par-tially set aside, since the parties now are aware of the conditions for this. The decisions may also have an effect on how arbitral tribunals draft their awards and how the parties present their cases. (Less)
