- Allemansrätten är en rättighet med gamla anor som omfattar stor del av Sveriges yta och tillfaller alla som bor i och vistas i Sverige. Rättighetens materiella innehåll kan endast delvis utläsas ur lag och då närmast uteslutande motsatsvis ur lagbestämmelser. Istället har allemansrätten sin lagliga grund i sedvana. Att det inte alltid står klart vilka rättigheter till annans mark allemansrätten ger, skapar ibland intressekonflikter. Att det inte alltid står klart vilka rättigheter till annans mark allemansrätten ger, skapar ibland intressekonflikter. Grundat på detta är uppsatsens huvudsakliga syfte att undersöka hur enskilda markägare påverkas av allemansrätten. Ett annat syfte är att undersöka hur allemans-rätten har utvecklats historiskt och vad som är gällande rätt idag. Uppsatsen syftar även till att undersöka om allemansrätten i förhållande till markägarnas intressen är proportionerlig samt om det vore önskvärt att reglera allemansrätten i lag i större utsträckning.
De frågeställningar som uppsatsen besvarar är: Hur har allemansrätten utvecklats i det svenska rättssystemet? Vad är gällande rätt i det svenska rättssystemet avseende allemansrätten? Hur påverkar allemansrätten en-skilda markägare? Hur ser allemansrätten ut i, och hur hanteras den i, Fin-lands respektive Danmarks rättssystem? Är allemansrätten proportionerlig i förhållande till markägarnas inskränkningar av bestämmanderätt över sin mark i det svenska rättssamhället? Bör allemansrätten regleras i lag i större utsträckning i svensk rätt?
För att få en förståelse för hur allemansrättens faktiska uppfattas av aktörer som på olika sätt påverkas av allemansrätten, genomfördes en enkätundersökning. Undersökningens svar har använts för att besvara frågeställningarna. De metoder som använts för att besvara uppsatsens frågeställningar och syfte är den rättsdogmatiska metoden, den rättsanalytiska metoden, den rättshistoriska metoden samt den komparativa metoden.
De slutsatser jag kommit fram till är att allemansrätten, till följd av sin rättsliga utformning och innehåll, kan vara oproportionerlig i förhållande till enskilda markägare i vissa fall. Dock är det svårt att fastställa om allemansrätten som sådan är oproportionerlig då enskilda markägare lär ha olika intressen som vägs mot de allmänna. Det har även konstaterats att det skulle vara önskvärt att i större utsträckning reglera allemansrätten i lag. Vid författandet av regleringen kan inspiration hämtas från dansk och finsk lagstiftning. Slutligen har utredningen kommit fram till att allemansrätten inte längre strikt kan anses vara civilrättslig. På grund av det allmännas tydliga intressen i och mål med allemansrätten samt Naturvårdsverkets sätt att med auktoritet vägleda vid allemansrättsliga frågor, kan det allmänna inte friskriva sig från ansvar. Detta möjliggör en proportionalitetsbedömning både enligt EKMR och allmänna svenska rättsgrundsatser samt möjlighet till ersättning till markägare när allemansrätten överträds och de lider skada. - The common (legal) right of access to private land, "allemansrätten", is an established privilege that concerns most of Sweden’s territory and applies to anyone living in or staying in the country. The material content of the right can only partially be recognized in the legislation and then almost exclusively e contrario. Instead, the common legal right of access to private land is mainly based on societal custom. The fact that there are differences in the interpretations of the common legal right of access to private land, causes conflicts of interest. Therefore, the main purpose of the thesis is to investigate how private landowners are affected by the common legal right of access to private land, along with how the right has developed historically and what rights are in force today. The thesis also aims to examine if the common legal right of access to private land in respect of the private landowner’s interests is proportionate, as well as if it would be desirable to more comprehensively regulate the right to roam in Swedish legislation.
The research questions addressed in the thesis are as follows: How has the right to roam developed in the Swedish legal system? What is the current legal position of the right to roam in the Swedish legal system? How does the right to roam affect individual private landowners? What are the current legal arrangements regarding the corresponding rights to the common legal right of access to private land in the legal systems of Finland and Denmark respectively? Is the common legal right of access to private land proportionate in relation to the restrictions it imposes on landowners’ control over their property in Swedish society? Should the common legal right of access to private land be more comprehensively regulated in Swedish law?
To understand how the right to roam is perceived by Swedish organisations, affected by it in various ways, a survey was conducted. The answers to the survey have been used to answer the research questions of the thesis. The methods used to answer the thesis’s research questions and purpose were the legaldogmatic method, the legal-analytical method, the legalhistorical method, and the comparative method.
The conclusions drawn from the thesis’s investigation are that the common legal right of access to private land, due to its legal design and content, may be disproportionate for individual landowners in certain cases. However, it is difficult to determine whether the common legal right of access to private land as such is disproportionate, as individual landowners are likely to have different interests that must be weighed against the public interest. It has also been established that the common legal right of access to private land would benefit from being further regulated in law, with inspiration potentially taken from Danish and Finnish legislation. Finally, the investigation concludes that the right to roam can no longer strictly be considered a matter of private law. Due to the public authorities’ clear interests in, and goals for, the right to roam, as well as the National environmental protection agency’s (Naturvårdsverket) authoritative way of advising on issues related to it, the state cannot deny responsibility. This allows for a proportionality assessment under both the European Court of Human Rights and general Swedish legal principles, as well as the possibility of compensation to landowners when the common legal right of access to private land is violated and the land is damaged.
