- Denna uppsats undersöker den intresseavvägning som domstolar gör vid prövning av straffprocessuella editions- och exhibitionsförelägganden enligt 38 och 39 kap. rättegångsbalken. Edition och exhibition avser skyldigheten att förete skriftliga handlingar eller föremål som kan ha betydelse som bevis i rättsliga förfaranden. Genom rättspraxis har ett krav på intresseavvägning etablerats, trots avsaknad av uttrycklig lagreglering. Intresseavvägningen har huvudsakligen utvecklats inom civilprocessen men tillämpades på straffprocessen genom Högsta domstolens avgörande NJA 2024 s. 618 ("Det filmade upploppet").

På editionssökandens sida finns intresset av effektiv brottsbekämpning och tillgång till relevant bevisning, där brottets allvarlighet och bevisningens relevans utgör centrala faktorer. På editionssvarandens sida beaktas intressen som personlig integritet och, i vissa fall, pressfrihet. Europarätten, både EU-rätten och Europakonventionen, har påverkat bedömningen vilket medfört att editionssvarandens intressen tillmäts ökad tyngd. Högsta domstolen har även beaktat tredjemansintressen inom ramen för intresseavvägningen när de begärda handlingarna innehåller personuppgifter om personer som inte är parter i förfarandet.
Uppsatsen analyserar vidare hur de intressen som beaktas i intresseavvägningen förhåller sig till straffprocessens funktioner, däribland sanningssökande, brottsbekämpning och rättssäkerhet. En central slutsats är att NJA 2024 s. 618 bekräftar att samma intresseavvägning som utvecklats i civilprocessen gäller i straffprocessen, men att intresset av brottsbekämpning, varvid brottets allvarlighet är relevant, utgör en särskild faktor vid bedömningen. - This thesis examines the balancing of interests that courts undertake when assessing applications for criminal procedural edition and exhibition orders pursuant to Chapters 38 and 39 of the Swedish Code of Judicial Procedure. Edition and exhibition refer to the obligation to produce written documents or objects that may be of significance as evidence in legal proceedings. Through case law, a requirement for balancing of interests has been established, despite the absence of explicit statutory regulation. The balancing of interests has primarily developed within civil procedure but was applied to criminal procedure through the Supreme Court's ruling in NJA 2024 p. 618 ("The Filmed Riot") (Sw. “Det filmade upploppet”).

Edition and exhibition refer to the obligation to produce written documents or objects that may be of significance as evidence in legal proceedings. Through case law, a requirement for balancing of interests has been established, despite the absence of explicit statutory regulation. The balancing of interests has primarily developed within civil procedure but was applied to criminal procedure through the Supreme Court's ruling in NJA 2024 p. 618 ("The Filmed Riot") (Sw. “Det filmade upploppet”).
On the side of the party seeking edition, there is an interest in effective crime prevention and access to relevant evidence, where the seriousness of the offence and the relevance of the evidence constitute central factors. On the side of the party subject to the edition order, interests such as personal integrity and, in certain cases, press freedom are taken into account. European law, both EU law and the European Convention, has influenced the assessment, resulting in increased weight being accorded to the interests of the party subject to the edition order. The Supreme Court has also taken thirdparty interests into consideration within the framework of the balancing of interests when the requested documents contain personal data concerning persons who are not parties to the proceedings.
The thesis further analyses how the interests considered in the balancing of interests relate to the functions of criminal procedure, including truthseeking, crime prevention and legal certainty. A central conclusion is that NJA 2024 p. 618 confirms that the same balancing of interests developed in civil procedure applies in criminal procedure, but that the interest in crime prevention, whereby the seriousness of the offence is relevant, constitutes a particular factor in the assessment.
