Sanning eller konsekvens: En analys av möjligheten att bekämpa desinformationsspridning

Abstract (Swedish)
Denna uppsats undersöker om svensk konstitutionell rätt tillåter begränsningar av yttrandefriheten i syfte att bekämpa spridningen av desinformation, samt om sådana begränsningar bör vara tillåtna. Med utgångspunkt i en rättsdogmatisk undersökning av regeringsformen, tryckfrihetsförordningen och yttrandefrihetsgrundlagen, vilket kompletteras med ett kritiskt perspektiv, visar uppsatsen att även om relevanta begränsningar inte är formellt uteslutna sätter det konstitutionella ramverket snäva praktiska gränser. Detta är särskilt till följd av censurförbudet och det starka skyddet för fri åsikts- och opinionsbildning.

Denna uppsats undersöker om svensk konstitutionell rätt tillåter begränsningar av yttrandefriheten i syfte att bekämpa spridningen av desinformation, samt om sådana begränsningar bör vara tillåtna. Med utgångspunkt i en rättsdogmatisk undersökning av regeringsformen, tryckfrihetsförordningen och yttrandefrihetsgrundlagen, vilket kompletteras med ett kritiskt perspektiv, visar uppsatsen att även om relevanta begränsningar inte är formellt uteslutna sätter det konstitutionella ramverket snäva praktiska gränser. Uppsatsen kan därefter dra slutsatsen att yttrandefrihetsbegränsningar som syftar till att bekämpa spridningen av desinformation med demokratisk motivering eller annat legitimt skyddsintresse är normativt problematiska, givet desinformationsbegreppets natur och det efterföljande sanningsbestämmandet, i fallet från det allmänna, vilket enligt uppsatsen riskerar att underminera de konstitutionella principer som eventuell begränsning är avsedd att skydda. Det svenska konstitutionella systemets restriktiva hållning bör således inte förstås som en regelbrist, utan som ett medvetet uttryck för konstitutionell återhållsamhet. (Less)

The paper uses a doctrinal legal analysis (sw. juridisk metod) for reviewing the Instrument of Government, The Freedom of the Press Act, Fundamental Law on Freedom of Expression.

Thereafter, nuanced by a critical normative perspective, the paper finds that while limited restrictions are neither formally nor on principle excluded in Swedish constitutional law, the framework sets a narrow scope in terms of practical limits. This paper aims to examine whether Swedish constitutional law allows for the restriction of freedom of expression in order to combat the spread of disinformation, and subsequently whether such restrictions ought to be allowed. The paper uses a doctrinal legal analysis (sw. juridisk metod) for reviewing the Instrument of Government, The Freedom of the Press Act, Fundamental Law on Freedom of Expression.

Thereafter, nuanced by a critical normative perspective, the paper finds that while limited restrictions are neither formally nor on principle excluded in Swedish constitutional law, the framework sets a narrow scope in terms of practical limits. This is particularly due to the prohibition of prior review of media, and the strong protection for freedom of opinion and expression. The paper concludes that a restriction on freedom of expression aimed at combating disinformation claiming democracy or other legitimate interests, are normatively problematic, given the nature of disinformation and the determination of truthfulness, which according to the paper risks undermining the very constitutional principles they are intended to protect. The Swedish constitutional system restrictive approach should thus be understood not as regulatory deficiency, but as deliberate expression of constitutional restraint. (Less)
