- I takt med allt mer omfattande globala klimatförändringar växer behovet av förnybara energikällor, såsom solenergi. Det har därför blivit allt vanligare att entreprenörer väljer att ansöka om att få anlägga solcellsparker på jordbruksmark. Förfarandet för en sådan prövning bedöms utifrån 3 kap 4 § miljöbalken och är rättsligt komplicerat. Dessutom ska miljöbalkens övergripande mål om hållbar utveckling alltid vägas in i beslutet. En potentiell lösning på detta komplicerade förfarande är så kallade solsambruksanläggningar. Sådana anläggningar har emellertid aldrig prövats i svensk rätt.

Denna uppsats utreder hur prövningen för solcellsanläggningar ser ut enligt 3 kap. 4 § MB och vilka intressekonflikter som aktualiseras därigenom. Vidare utreds i vilken mån miljöbalkens övergripande mål i 1 kap. 1 § MB om hållbar utveckling påverkar bedömningen. För att förstå begreppet hållbar utveckling utreds också de av riksdagen fastslagna miljökvalitetsmålen, då dessa anses vara vägledande vid tolkning av begreppet i 1 kap. 1 § MB. Slutligen utreder uppsatsen även frågan om hur en anläggning för solsambruk bör bedömas utifrån de slutsatser som kan dras efter de två inledande utredningarna.
I uppsatsen används rättsdogmatisk metod för att besvara respektive frågeställning. De källor som används är främst sådana sprungna ur den traditionella rättskälleläran. Två uppmärksammade rättsfall från MÖD, Svedbergadomen och Better Energy-målet, används löpande för att kontextualisera uppsatsens teman. Prövningen enligt 3 kap. 4 § MB är emellertid beroende av lokala och regionala förutsättningar. Uppsatsen har därför behövt behandla myndighetsunderlag och rapporter i syfte att klargöra hur rättsläget ser ut. För att besvara uppsatsens andra frågeställning har också viss utblick behövts göras till den internationella rätten och EU-rätten. Agenda 2030 och i viss mån EU:s grundläggande hållbarhetsbestämmelser används i syfte att belysa vidden av begreppet hållbar utveckling.
Uppsatsen konstaterar att prövningen av en solcellsanläggning är beroende av lokala förutsättningar och behov. Däremot står det klart att anläggningens storlek avgör för vilken typ av lokaliseringsprövning som behöver göras. Vad gäller miljöbalkens övergripande mål och miljökvalitetsmålen kan de endast indirekt utläsas i Mark- och miljööverdomstolens domskäl. Det konstateras dock att de övergripande målen och miljökvalitetsmålen är en del av bedömningen. Hur målen vägs in går emellertid inte att fastslå. Slutligen konstateras att anläggningar för solsambruk torde prövas på samma sätt som traditionella solcellsanläggningar mot bakgrund av att ett ingrepp på befintlig jordbruksmark i regel aktualiserar en prövning enligt 3 kap. 4 § MB (Less) - Abstract

The assessment is dictated by Chapter 3, Section 4 of the Swedish Environmental Code. However, the procedure for such an assessment is legally complex. Furthermore, the procedure must always take into account the Environmental Code’s overarching goal of sustainable development set out in Chapter 1, Section 1. A potential solution to this complicated procedure could be that of agrovoltaic systems. These kinds of systems have, however, never been subject to review in the Swedish Land and Environmental Court of Appeal.
This thesis examines how the assessment pursuant Chapter 3, Section 4 is carried out with regard to solar parks and what potential conflicts arise from this procedure. Furthermore, it examines how the overall goal of sustainable development in the Swedish Environmental Code influences this assessment. To further understand this concept, the environmental quality objectives set by the Swedish Parliament have been assessed, as they have been deemed guiding when interpreting the concept of sustainable development. Finally, it is examined how, based on the conclusions from the two previous analyses, agrovoltaic systems are predicted to be assessed according to the Environmental Code.
The research is carried out using legal dogmatic method. The sources used are mainly those found within the acknowledged authoritative sources within the Swedish legal framework. Those being statutory law, case-law, preparatory works and doctrine. Two cases from the Swedish Land and Environmental Court of Appeal are used throughout the thesis, in order to provide context to the theme. The assessment according to Chapter 3, Article 4 is, however, heavily influenced by local circumstances and local agency documents. Therefore, such documents and agency reports have also been examined in order to clarify how the procedure is carried out. In order to answer the thesis second question, it has been necessary to make an outlook on international law and EU-law. UN Agenda 2030 and EU acts relating to sustainable development have been used in order to widen the subject and understanding of sustainable development.
The study concludes that the assessment according to Chapter 3, Section 4 is dependent on local circumstances. In spite of this, it is also concluded that the size of the planned solar park determines how the location assessment should be carried out. The influence of the overall goals of the Swedish Environmental Code and the environmental quality objectives are only indirectly apparent in the Swedish Land and Environmental Court of Appeal’s reasoning. It is, however, concluded that they should be a part of the assessment, but how remains uncertain. Finally, it is concluded that agrovoltaic systems will most probably be assessed as traditional solar parks in accordance with Chapter 3, Article 4, as any intervention on agricultural land generally triggers an assessment pursuant to Chapter 3, Section 4.
