Syftet med uppsatsen är att undersöka

Syftet med uppsatsen är att undersöka
möjligheter och begränsningar knutna till befintliga och föreslagna kontrollåtgärder gällande efterlevnaden av kollektivavtal inom ramen för den svenska modellen, som ett led i att motverka arbetslivskriminalitet. Utgångspunkten för vilka åtgärder som undersöks och analyseras närmare är dels de föreslagna åtgärder som presenterats i SOU 2024:14 och SOU 2025:25, dels några av de implementerade branschåtgärderna. Undersökningen genomförs
med den rättsanalytiska metoden, den rättspolitiska metoden och den komparativa metoden. Den komparativa metoden nyttjas i en kortare utblick mot Finland.

Det tydliggörs i uppsatsen att bristande efterlevnad av kollektivavtal räknas
som ett arbetslivskriminellt upplägg. Kontrollen av kollektivavtal sköts i
första hand av de fackliga organisationerna enligt den svenska modellens
traditionella uppdelning av ansvar mellan staten och arbetsmarknadens parter.
I och med de växande problemen som arbetslivskriminaliteten skapar har allt
fler frågor väckts om hur kontrollen av bristande kollektivavtal bör bedrivas
och av vem, och hur detta skulle påverka den svenska modellen.

Uppsatsen utför en närmare granskning av byggbranschen och städbranschen,
som båda har återkommande problem med bristande efterlevnad av kollektivavtal. Det är tydligt att trots branschernas fördjupade kontrollåtgärder, utöver den ordinära fackliga övervakningen, så uteblir den önskade effektiviteten. Detta beror bland annat på bristande resurser, långa entreprenadkedjor
och bruket av utrikes födda arbetstagare, som i lägre grad är anslutna till ett svenskt fackförbund.

De tre förslag på ytterligare åtgärder som läggs fram i de statliga utredningarna behandlas ingående. Jämförelser görs också med den finska modellen och dess allmänt bindande kollektivavtal. Förslaget om att ge utökad befogenhet till Arbetsmiljöverket att informera parterna om bristande efterlevnad
av kollektivavtal i samband med myndighetens arbetsplatskontroller bedöms
ha god potential att bli en effektiv kontrollåtgärd, delvis på grund av dess
breda räckvidd. Däremot riskerar förslaget att öppna för en förskjutning av
den svenska modellens ansvarsområden. De två andra förslagen bedöms däremot ha bara en positiv, förstärkande effekt på den svenska modellen, men de skulle potentiellt också bädda för mindre effektiva kontrollåtgärder gällande
bristande efterlevnad av kollektivavtal. Dessvärre har inte något av förslagen
vidareutretts. Det är oklart vad vägen framåt är. (Less)

This thesis examines whether current control measures regarding compliance with collective agreements are sufficiently effective, and how any additional control measures would affect the lack of compliance with collective agree
ments and the Swedish model. The purpose of the thesis is to examine the possibilities and limitations associated with existing and proposed control measures regarding compliance with collective agreements within the frame
work of the Swedish model, as part of combating work-related crime. The starting point for which measures are examined and analysed in more detail is partly the proposed measures presented in SOU 2024:14 and SOU 2025:25,

This thesis examines whether current control measures regarding compliance with collective agreements are sufficiently effective, and how any additional control measures would affect the lack of compliance with collective agree
ments and the Swedish model. The purpose of the thesis is to examine the possibilities and limitations associated with existing and proposed control measures regarding compliance with collective agreements within the frame
work of the Swedish model, as part of combating work-related crime. The starting point for which measures are examined and analysed in more detail is partly the proposed measures presented in SOU 2024:14 and SOU 2025:25,
and partly some of the implemented industry measures. The investigation is carried out using the legal analytical method, the legal policy method and the comparative method. The comparative method is used in a brief outlook on Finland.

The thesis clarifies that non-compliance with collective agreements is considered a form of work-related crime. The control of collective agreements is primarily carried out by the trade unions according to the Swedish model's
traditional division of responsibility between the state and the social partners. With the growing problems that work-related crime creates, more questions have been raised about how the control of non-compliance with collective agreements should be conducted and by whom, and how this would affect the
Swedish model.

The construction and cleaning industries are examined closely in the thesis, both of which have recurring problems with non-compliance with collective agreements. Despite the industries’ in-depth control measures, in addition to ordinary union supervision, the desired efficiency is not being achieved. This
is due, among other things, to a lack of resources, long contracting chains and
the use of foreign-born workers, who are less likely to be affiliated with a Swedish union.

The three proposals for further measures put forward in the government investigations are discussed in detail. Comparisons are also made with the Finnish model and its generally binding collective agreement. The proposal to give the Swedish Work Environment Authority increased authority to inform the social parties about non-compliance with collective agreements in connection with the authority's workplace inspections, is considered to have good potential to become an effective control measure, partly due to its broad scope. However, the proposal risks creating an opening for a shift in the Swedish model's areas of responsibility. The other two proposals, on the other hand, are considered to have only a positive, reinforcing effect on the Swedish
model, but they would also potentially pave the way for less effective control measures regarding non-compliance with collective agreements. Unfortunately, none of the proposals have been further investigated. It is uncertain what the way forward is. (Less)
