- Abstract
- The purpose of this paper has been to examine how the courts produce and reproduce ideas of male and female with regards to 3 § in the Youth Act. Since the court must present an objective and unbiased state of affairs, it has also been my intention to examine whether what is held for objective states of affairs can be the result of opinions, standards and values that are accepted as true because they are presented as objective.
The theoretical starting point of this study is post-structuralist and feminist theory. The issue at hand focuses on what the Administrative Court describes as the reasons for care in relation to gender. The study is based on 31 court rulings of care of youths according to 3 § Youth Act.

Reconstruction and interpretation of the rulings have been necessary in order to clarify the issues. In the analysis and interpretation of the rulings I have used hermeneutics and found inspiration in discourse analysis. I have chosen to systemise the body of material in categories
of She and He and analysed them in terms of similarities and differences. The point I want to make is that the descriptions of Her and Him in the court rulings show different ideas of male/female, and that the rulings thus confi rm prevailing, normative notions of gender and as a result
contribute to maintain prevailing gender structures. (Less)
