Abstract
This thesis is intended to analyse the religious liberties recognized by the international human rights' instruments in secular education, to discuss the legal approaches, interpretations, case laws of different international human rights bodies and to understand how religious liberties interact with public education in secular states in terms of practice and theory. This thesis is intended to analyse the religious liberties recognized by the international human rights' instruments in secular education, to discuss the legal approaches, interpretations, case laws of different international human rights bodies and to understand how religious liberties interact with public education in secular states in terms of practice and theory. In modern world and especially in western developed states, which claim to be multicultural and secular society, freedom of religion or belief has become very important issue due to different religions and beliefs in the society, which are supposed to enjoy the same protection under international legal instruments. Religion in secular public education embraces the religious liberties endowed by the international human rights instruments and bodies, the interrelations between religion and education, and the legal outcomes from this mutual relationship. This thesis will analyze the notion of religion, secularism and public education, reflect different scholarly approaches and theories, examine international instruments, which assure freedom of thought, conscious and religion or belief, take surveys to the case-laws of different secular states, analyze and compare the case laws of Human Rights Committee (HRC) under International Covenant on Civil and Political Rights (ICCPR) and European Court of Human Rights.
