- The summary of the present master thesis can be outlined as the following: The international terrorism and the counter-terrorism have been one of the biggest issues and concerns of the international community over the last decades. The international terrorism aims at the very destruction of human rights, democracy and the rule of law. There is no question and the debate that the international terrorism should be fought against but one should not sacrifice the issue of human rights and fundamental freedoms protection to this goal. - The summary of the present master thesis can be outlined as the following: The international terrorism and the counter-terrorism have been one of the biggest issues and concerns of the international community over the last decades. The international terrorism aims at the very destruction of human rights, democracy and the rule of law. There is no question and the debate that the international terrorism should be fought against but one should not sacrifice the issue of human rights and fundamental freedoms protection to this goal. The absence of the comprehensive, precise and legally binding definition of the international terrorism is a problematic for the effective protection and promotion of human rights and fundamental freedoms while combating the international terrorism. With the adoption of the definition of the international terrorism in a legally binding instrument on the global level, the fight against it will be more consolidated, consistent, targeted, efficient and respectful for the guaranteeing the human rights and fundamental freedoms. The United Nations Security Council's targeted sanctions regimes have a direct, negative impact on the protection, realization and enjoyment of a number of fundamental rights and freedoms. The United Nation Security Council is bound by the human rights law obligation at least to the extant flowing from the United Nation's constitutional document - the United Nation's Charter, and the United Nations Security Council should adhere to the international human rights law standards while designing the targeted sanctions regimes. The targets of the United Nations Security Council's targeted sanctions regimes should have access to justice. (Less)
