- Förändringar inom en organisation är något vi alla kommer att möta någon gång under vår
yrkeskarriär. Vid dessa tillfällen finns det ett flertal olika lagar och föreskrifter som äger
tillämplighet. De tre vanligaste rättsreglerna är Arbetsmiljölagen, Medbestämmandelagen och
föreskriften om systematiskt arbetsmiljöarbete. Det som skiljer regelverken åt är att
Arbetsmiljölagen och föreskriften om systematiskt arbetsmiljöarbete tillhör den
offentligrättsliga delen, medan Medbestämmandelagen tillhör den civilrättsliga. Detta betyder
att det finns olika intressenter och möjligheter till inflytande över en verksamhetsförändring.
Historiskt sett har denna uppdelning varit skarp då den offentligrättsliga delen har haft en

redogöra för hur rättsläget ser ut mellan de olika rättsreglerna, utifrån ett före-, -under och ett
efterperspektiv på en förändring. Detta för att se om det föreligger någon synergi mellan de
olika rättsreglerna som möjliggör att dessa inte ska tillämpas separat, utan att i stället tillämpas
