Divorce and separation are a part and parcel of modern family life in western society. However the separation process can sometimes get out of hand, especially when children are involved. Long custody fights in the courts are not only harmful to the children but are also costly for society. Divorce and separation are a part and parcel of modern family life in western society. However the separation process can sometimes get out of hand, especially when children are involved. Long custody fights in the courts are not only harmful to the children but are also costly for society. Mediation, between parents who have separated or are in the process of separating, is an instrument used in many societies to prevent this kind of development. Municipalities in Sweden are obliged by law to offer mediation to parents who have separated or are in the process of separating. The semi-structured interview method was used in this study, in which six family law mediators offered their respective views on the mediation process. Views on the parent’s conflict, which solutions best serve the children’s interests after the parent’s separation and how family law mediators interact with the parties in the mediation process, were analysed using theories of discretion. The results show that family law mediators use their discretion considerably in many aspects of the mediation process but are cautious when it comes to children’s participation in the process. (Less)
