- Abstract
- Child pornography appears to be a criminal offence universally condemned. Nonetheless, a discussion of the artistic value and freedom of speech in contrast to the responsibility to protect our children from commercial sexual exposition has developed in recent years. The purpose of this thesis is therefore to examine the underlying theories and arguments concerning the artistic freedoms and ethics in the context of child pornography. - Child pornography appears to be a criminal offence universally condemned. Nonetheless, a discussion of the artistic value and freedom of speech in contrast to the responsibility to protect our children from commercial sexual exposition has developed in recent years. The purpose of this thesis is therefore to examine the underlying theories and arguments concerning the artistic freedoms and ethics in the context of child pornography. The Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography was adopted by the General Assembly on 25 May 2000 in order to illustrate the increasing challenges with sexual exploitation of children, including strengthen the Convention on the Rights of the Child’s article 34. Child pornography is a global phenomenon which causes children exposed to sexual abuse severe psychological and physical trauma, but what happens when the material of child pornography is depicted in fictional series and illustrations is difficult to determine. From a recent Swedish court case this paper will examine the complexity of art, freedom of speech and child pornography. (Less)
