- Abstract
- On January 1, 2010 Transportstyrelsen became responsible for withdrawing taxi driver licenses, which before was a responsibility of länsstyrelsen. In the process of a withdrawal, bureaucrats at these public authorities implement a law, made by lawyers, probably meant to be used by lawyers. The objective of the law, which the decisions of withdrawal are founded on, has proven to be that no improper driver should be allowed to drive a taxi. In this context, the term “improper” is open for interpretation, and the empirical findings of the essay show that this may result in problems for bureaucrats lacking legal training. An example, which suggests that the term is interpreted in different ways, is a finding regarding the warnings. Sometimes taxi drivers receive a warning instead of having their license withdrawn. The empirical findings have shown that there is sometimes enough with only one crime committed after the warning to result in a license withdrawal, while the taxi driver in other cases can commit up to nine crimes between the warning and the withdrawal. The empirical findings have also shown that work load affect the processing. The purpose of this essay is to examine the manner, in which the bureaucratic administrators implement the law in withdrawing taxi driver licenses on the reason of crime, in between 2008-2011, in order to determine whether the withdrawals of taxi driver licenses comply with the principle of equality, and also what underlying elements affect the decision-making at the different public authorities. In order to examine the abovementioned, a document analysis together with a statistical analysis has been performed on the decisions of withdrawals made by both länsstyrelsen (2008-2009) and Transportstyrelsen (2010-2011).
