Abstract
This report contains the result of a survey made to investigate the social norms in collation to the law and its sentencing. Two crimes, rape and heavy tax crime were in focus and chosen based on its similar punishments and different victimization of the state and a rape victim.
The result shows that the victim is a big part of how we see different kind of crimes and how moral and emotional feelings affect our view of the crimes. Social norms have a huge influence on how a victim should react, feel and be treated. The court has made the comparison of different crimes according to the principle of proportion in a groundwork for changes in the law which shows that it’s possible to compare two crimes with similar punishment. A matrix was also made to compare ten cases of tax crime and rape and see if the social norms collaborate with the law. Both the court and the social norms decided that rape is always worse than crimes against the state and the court gave the offenders in rapes twice as high penalty than the tax criminals. (Less)
