Abstract
Wage formation today develops more and more towards a local and individual process and is considered to be primarily the responsibility of the different parties of the labor market. There is not much restricting contractual freedom like the one prevalent in Sweden, but Discrimination Act constitutes such. Discrimination Act restricts freedom of contract in the sense that the employer or the parties are not completely free to choose how to implement its wage-forming processes. It is absolutely forbidden to discriminate groups for the benefit of other groups, which is particularly true when wages are formed. Wage formation today develops more and more towards a local and individual process and is considered to be primarily the responsibility of the different parties of the labor market. There is not much restricting contractual freedom like the one prevalent in Sweden, but Discrimination Act constitutes such. Discrimination Act restricts freedom of contract in the sense that the employer or the parties are not completely free to choose how to implement its wage-forming processes. This thesis describes employment law for the legal situation in Sweden regarding the prohibition of discrimination in the payroll process. The premise is that there are different and thus unequal requirements between the sexes in society today, which is an advantage for men in the individual wages. Lönebildningen idag går mer och mer mot en lokal och individuell process och anses primärt vara ett ansvar för arbetsmarknadens parter. Det finns inte mycket förutom Diskrimineringslagen som inskränker den avtalsfrihet som råder i Sverige. Diskrimineringslagen inskränker avtalsfriheten på så vis att arbetsgivaren eller parter inte helt fritt kan välja hur lönesättningsprocessen ser ut. Det strider mot lagen att missgynna grupper till förmån för andra, vilket inte minst gäller när löner ska sättas. Lönerna måste vara objektivt grundade, och lika lön för lika arbete är ett krav så länge arbetstagarna arbetar utefter samma förutsättningar.
