Tredje mans talerätt i överprövningsmål vid offentlig upphandling

Offentliga inköp av varor, tjänster och byggentreprenader som görs av statliga och kommunala myndigheter måste föregås av en offentlig upphandling enligt lag (2007:1091) om offentlig upphandling. Leverantören av varan, tjänsten eller byggentreprenaden som anser att en upphandling inte har gått rätt till, kan ansöka om överprövning av en upphandling till allmän förvaltningsdomstol enligt 16 kap. 4 § lagen om offentlig upphandling. Regleringen bygger på unionsrätten, där rätten till effektiva rättsmedel föreskrivs.
Andra leverantörer som tidigare har deltagit i upphandlingen kan bli påverkade av ett domstolsavgörande om överprövning. Frågan uppstår då när de har rätt att träda in i processen och föra sin talan, s.k. tredjemansinträde.... (More)

Leverantören av varan, tjänsten eller byggentreprenaden som anser att en upphandling inte har gått rätt till, kan ansöka om överprövning av en upphandling till allmän förvaltningsdomstol enligt 16 kap. 4 § lagen om offentlig upphandling. Regleringen bygger på unionsrätten, där rätten till effektiva rättsmedel föreskrivs.
Andra leverantörer som tidigare har deltagit i upphandlingen kan bli påverkade av ett domstolsavgörande om överprövning. Frågan uppstår då när de har rätt att träda in i processen och föra sin talan, s.k. tredjemansinträde. Regleringarna som i praxis har gett tredje man talerätt finns i förvaltningsprocesslagen (1971:291).

Vad avser tredje mans talerätt har praxis förändrats kraftigt de senaste åren. Från att tredje man inte haft någon talerätt har denne fått talerätt, dock endast vid specifika omständigheter i det enskilda fallet. Rättsosäkerheten är då ett faktum och många frågor om tredje mans talerätt väcks.

Frågan är om inte tredje mans talerätt borde regleras i lagen om offentlig upphandling, dels för att unionsrätten uttryckligen uppställer krav på rätten till effektiva rättsmedel för alla, även för tredje man, och dels för att leverantörer ska veta när de har talerätt i överprövningsmål.

Dessutom börjar överprövningsmål efter tredje mans utvidgade talerätt i stor utsträckning likna tvistemålsprocessen i allmän domstol och förvaltningsprocesslagens bestämmelser passar inte in på tredje mans talerätt i överprövningsmål vid offentlig upphandling.
Det är dags för lagstiftaren att införa nya bestämmelser om tredje mans talerätt i lagen om offentlig upphandling. (Less)
Abstract
Swedish contracting authorities purchasing public goods, services and public works contracts, are obliged to follow Swedish law on Public Procurement Act (2007:1091). If the procurement has not been correctly performed, an economic operator can apply for a review to the administrative court according to Chapter 16 § 4 in the Swedish law on Public Procurement Act. The regulation is based on European Union law, where the right to an effective legal remedy is provided.

Depending on the judgement of the court, other economic operators which previously participated in the public procurement may be negatively affected by the court’s judgement, for example by losing a contract. This essay investigates under what circumstances these economic... (More)

If the procurement has not been correctly performed, an economic operator can apply for a review to the administrative court according to Chapter 16 § 4 in the Swedish law on Public Procurement Act. This essay investigates under what circumstances these economic operators have a right to litigate and enter into the procedure, called ”third party entry”. Swedish case law has recently given third parties right to litigate under certain circumstances based on the Swedish law of Administrative Court Procedure Act (1971:291).

The right to litigate for third parties has changed significantly in the Swedish public procurement case law. Third parties did first not have the right to litigate, recently this was changed, but only under very specific circumstances in each case. Because of the obscure case law, the legal uncertainty is a fact and a growing number of questions are beeing raised about third parties rights to litigate.

The question is if third parties rights to litigate should be regulated in the Swedish Public Procurement Act, firstly because the European Union law explicity demands the right to effective remedies for everyone, even for third party, and secondly because the economic operators should know when they have the right to litigate in review cases.
Because of the right to litigate for third parties in review cases are becoming more similar to civil cases in general courts and the rules of the Swedish Administrative Court Procedure Acts are not applicable on third party’s right to litigate in review cases in public precurement.
It’s time for the legislator to institute new rules for third party’s right to litigate in the Swedish Public Procurement Act. (Less)
