Detta är en kritisk granskning av Psykiatrilagsutredningens förslag om att införa ett dispensförfarande för extraordinära tvångsåtgärder inom den slutna psykiatriska tvångsvården. Förslaget innebär att en tvångsåtgärdsnämnd ska ge tillstånd att vidta tvångsåtgärder som överskrider de lagstadgade tidsgränserna och att använda andra typer av tvångsåtgärder än de som anges direkt i lagen.
Att bli inlåst utan att ha begått något brott är ett stort ingrepp i den personliga självbestämmanderätten. Tvångsåtgärder som fastspänning och isolering inskränker patientens grundlagsstadgade rättigheter ytterligare. Förslaget innebär att en tvångsåtgärdsnämnd ska ge tillstånd att vidta tvångsåtgärder som överskrider de lagstadgade tidsgränserna och att använda andra typer av tvångsåtgärder än de som anges direkt i lagen.
Att bli inlåst utan att ha begått något brott är ett stort ingrepp i den personliga självbestämmanderätten. Tvångsåtgärder som fastspänning och isolering inskränker patientens grundlagsstadgade rättigheter ytterligare. Därför är det ytterst viktigt att tvångsvård är präglad av respekt för integritet och att den uppfyller andra rättssäkerhetskrav. Mycket kritik har framförts mot missbruk av tvångsåtgärder de senaste åren, bland annat i media. 2008 gavs Psykiatrilagsutredningen i uppdrag att reformera tvångsvårdslagstiftningen och kom avseende tvångsåtgärder bland annat med förslaget att införa Tvångsåtgärdsnämnden.
Syftet med denna uppsats är att undersöka om Psykiatrilagsutredningens förslag om införande av en tvångsåtgärdsnämnd innebär en förbättring av patientens rättssäkerhet.
Resultatet av undersökningen kan sammanfattas som följer. Det kan konstateras att förslaget innehåller ett flertal rättssäkerhetsbrister. I formellt rättssäkerhetshänseende framförallt eftersom förslaget i brist på precision och restriktivitet öppnar för godtycklig maktutövning. I materiellt rättssäkerhetsavseende kan nämndens uppgift starkt ifrågasättas – att legitimera gravt integritetskränkande tvångsåtgärder mot de mest utsatta individerna inom vården. Dessutom finns i förslaget inneboende brister i patientinflytande och kontroll, inte minst eftersom ett underkännande av en redan utförd tvångsåtgärd är meningslös för patientsäkerheten i det enskilda fallet. Syftet med förslaget är att förbättra patienternas rättssäkerhet, men det riskerar att få motsatt effekt. (Less)

This is a critical examination of a proposal by the Psychiatric Law Investigation to introduce a dispensation practice for extraordinary coercive measures within closed compulsory psychiatric care. The proposal concerns the establishment of a board for coercive measures to grant permission for coercive measures that exceed legal time limits and for other kinds of coercive measures than those directly stated in law.
To be incarcerated without having committed a crime is a major encroachment on the right to self-determination. Coercive measures such as mechanical restraints and isolation further limit the patient’s constitutional rights. To be incarcerated without having committed a crime is a major encroachment on the right to self-determination. Coercive measures such as mechanical restraints and isolation further limit the patient’s constitutional rights. Therefore it is of the utmost importance that compulsory psychiatric care is informed by respect for personal integrity and that it fulfills other legal security demands. Much criticism has been leveled against abuse of coercive psychiatric measures in recent years, for instance in the media. In 2008 the Psychiatric Law Investigation was given the task of reforming the laws for compulsory psychiatric care and introduced, among other proposals, a proposal for a Board for coercive measures.
The purpose of this paper is to examine whether the Psychiatric Law Investigation’s proposal for the establishment of a board for coercive measures would entail an improvement of the patient’s legal security.
The result of the investigation can be summarized as follows. It can be established that the proposal entails a number of legal security flaws. From a formal legal security standpoint it is primarily the proposal’s lack of precision and restrictiveness that open to arbitrary exercise of power. From a material legal security standpoint the board’s task can be seriously questioned – to legitimize integrity violating coercive measures against the most vulnerable individuals in the healthcare system. The proposal also contains inherent shortcomings in patient influence and control, not least because the formal rejections of already executed coercive measures are meaningless to patient security in the individual case. The purpose of the proposal is to improve the legal security of the patients, but there is a risk of it having the opposite effect. (Less)
