Barnets bästa - en studie av FB 6:2 a och vårdnadsavgöranden vid Malmö tingsrätt

Uppsatsen behandlar begreppet barnets bästa. Begreppet regleras i föräldrabalken 6:2 a och skall vara avgörande vid alla beslut om vårdnad, boende och umgänge. Syftet med uppsatsen är att försöka klargöra innebörden av begreppet barnets bästa genom en noggrann genomgång av lagtext, förarbeten, doktrin samt avgöranden från Malmö tingsrätt. Som en del i detta undersöks om Malmö tingsrätt låter barnet komma till tals samt om barnets vilja beaktas vid beslut om vårdnad, boende samt umgänge.

Syftet med uppsatsen är att försöka klargöra innebörden av begreppet barnets bästa genom en noggrann genomgång av lagtext, förarbeten, doktrin samt avgöranden från Malmö tingsrätt. Som en del i detta undersöks om Malmö tingsrätt låter barnet komma till tals samt om barnets vilja beaktas vid beslut om vårdnad, boende samt umgänge.

I barnkonventionen vilket Sverige har ratificerat och tillträtt, stadgar artiklarna 3 samt 12 barnets bästa och barnets rätt att komma till tals. Barnkonventionen betonar att barnets bästa ska vara avgörande vid alla beslut och åtgärder som rör barnet. Svensk lag är anpassad till att följa konventionen och vi har i svensk rätt fått bestämmelsen i FB 6:2 a för att tydligare implementera barnkonventionen. Vid beslut om vårdnad, boende och umgänge, skall rätten hämta sin utgångspunkt i FB 6:2 a samt FB 6:1. Hänsyn skall även tas till föräldrarnas förmåga att samarbeta rörande barnet, FB 6:5 2 st. Rätten skall göra en individuell bedömning av varje enskilt fall och situationen skall bedömas ur ett barnperspektiv. Vad som menas med ett barnperspektiv är att beslutsfattaren sätter sig in i barnets situation samt ser omständigheterna med barnets ögon. Idag finns det inga tydliga riktlinjer kring vad begreppet barnets bästa innefattar och enligt lagstiftaren är det inte önskvärt med fastställda objektiva kriterier. Forskare inom ämnet framhåller att ett huvudsakligt problem med begreppet barnets bästa, är att begreppet är vagt utformat och önskar ytterligare riktlinjer kring begreppet.

Vid undersökning av Malmö tingsrätts vårdnadsavgöranden fann jag att de följer lagtext och förarbeten vid bedömningen av barnets bästa, men att det var svårt att utläsa ur avgörandena hur tingsrätten låter barnet komma till tals. Som följd av uppsatsens studie anser jag att begreppet barnet bästa skulle behöva utförligare riktlinjer kring begreppets innebörd. Detta hade resulterat i en minskad ovisshet kring vad begreppet barnets bästa innebär. (Less)
Abstract
This paper discusses the concept of the best interests of the child. The best interest of the child is regulated in the Parental Code (Föräldrabalk (1949:381)) 6th chapter 2 a, and shall be conclusive in all decisions concerning custody, residence and contact. The purpose of this paper is to try to clarify the concept of the best interests of the child through a thorough review of the statutory text, its legislative history, doctrine and decisions of the District Court of Malmö. Particular interest will be on how the District Court of Malmö respects the views of the child and if the child’s wishes are taken into account in the decisions concerning custody, residence and contact.

This paper discusses the concept of the best interests of the child. The best interest of the child is regulated in the Parental Code (Föräldrabalk (1949:381)) 6th chapter 2 a, and shall be conclusive in all decisions concerning custody, residence and contact. The purpose of this paper is to try to clarify the concept of the best interests of the child through a thorough review of the statutory text, its legislative history, doctrine and decisions of the District Court of Malmö. Particular interest will be on how the District Court of Malmö respects the views of the child and if the child’s wishes are taken into account in the decisions concerning custody, residence and contact.

In the Convention on the Rights of the Child, which Sweden has ratified and acceded, statute Articles 3 and 12 the best interest of the child and the respect for the views of the child. The convention emphasizes that the best interests of the child shall be conclusive in all decisions and actions taken regarding the child. Swedish law is adapted to comply with the Convention. As a result of this we have in Swedish law incorporated the paragraph 6:2 a in the Parental Code to clearly implement the Convention on the Rights of the Childs provisions. In decisions concerning custody, residence and contact, the court shall base their decisions in the sections 6:2 a and 6:1 of the Parental Code. Considerations must also be given to the parent’s ability to cooperate regarding the child, Parental Code 6:5. The court shall make an individual evaluation of each case and the assessment of the situation should be from a child’s perspective. The decision is made based on the decision maker’s previous knowledge and attitude. Researchers in the area view the main concern of the concept of the best interest of the child as the concept being vague and realize the need for further guidance around the concept of the best interests of the child.

Upon examination of rulings from the District Court of Malmö, I found that they follow the statutory text and its legislative history in assessing the best interest of the child, but that it in the rulings and assessments is not made how the District Court allows the child to be heard. As a result of the thesis study I conclude that the concept of the best interests of the child needs further guidance regarding the meaning of the concept. The effect of this would be reduced uncertainty around the concept of the best interests of the child. (Less)
