- Uppsatsen är en komparativ immaterialrättslig studie av svensk och amerikansk upphovsrätt. Frågeställningen gäller vilka undantag som kan göras från upphovsmannens rättigheter i svensk och amerikansk upphovsrätt. Uppsatsen fokuserar främst på den amerikanska doktrinen om Fair Use, som utgör en central del av den amerikanska upphovsrätten och regleras i 17 USC § 107. Undantagen från den svenska upphovsrätten utgår ifrån undantagskatalogen i 2 kap upphovsrättslagen. Den svenska citaträtten tas i speciellt beaktande. Syftet med uppsatsen är att beskriva de rättsliga regleringarna i respektive land, och sedan jämföra deras likheter och skillnader. Den amerikanska doktrinen om Fair Use syftar till att utifrån fyra kriterier bedöma om en viss användning av ett upphovsskyddat verk faller inom Fair Use, ”skäligt bruk”. Om användningen anses vara Fair Use betyder det att användningen är tillåten och strider inte mot rättighetsinnehava¬rens ensamrätt.
Undersökningen visar att det både finns stora likheter och skillnader mellan de rättsliga regleringarna av upphovsrätten. Många av skillnaderna beror på att länderna tillhör olika rättstraditioner, angloamerikansk common law i USA och kontinentaleuropeisk lagstiftningsbaserad rätt i Sverige. Det har talats om att det behövs en reglering liknande Fair Use även i europeisk rätt, för att möta de krav som nya tekniska utvecklingar ställer på upphovsrätten. Systemet med en undantagskatalog är svårt att anpassa till nya teknikutvecklingar, och genom att införa en Fair Use-liknande bestämmelse skulle den svenska upphovsrätten bli mer flexibel. - This paper is a comparative study concerning the limitations on the exclusive rights of the copyright owner in Swedish and American copyright law. The paper is primarily focused on the American Fair Use Doctrine, which is a central part of U.S. copyright and is codified in 17 USC § 107. The limitations on the exclusive rights in Swedish copyright law are found in Chapter 2 of the Swedish Copyright Act, and the Swedish “right to quote” in the Copyright Act 22 § will be examined in particular. The purpose of the paper is to describe the two separate legal systems, and compare their similarities and differences. The comparison is focused on the legislative purposes behind the copyright regulations.

The American Fair Use Doctrine is based on of four criteria which are used to determine whether a particular use of a copyrighted work is fair or not. If the use is determined fair, then the use is lawful according to the statute and does not infringe on the exclusive rights of the copyright owner.
The comparison between Swedish and American copyright law shows that there are both similarities and differences between the copyright legislations. Many of the differences are due to that the countries belong to separate legal traditions, Anglo-American common law in the United States and civil law in Sweden. It has been discussed if there is need of a Fair Use-regulation within the European copyright legislation, in order to meet the difficulties caused by new technological developments. The Swedish system of maintaining a catalog of exceptions from the exclusive rights of the copyright makes it difficult to adapt to new technological developments, and by introducing a provision similar to the Fair Use Doctrine, Swedish copyright law become more flexible.
