- Denna uppsats belyser hur ett generationsskifte av enskild näringsverksamhet kan genomföras samt vilka problem och ställningstagande som parterna kan ställas inför. Ett generationsskifte innebär ofta efterföljande skattemässiga konsekvenser, varför både överlåtaren och mottagaren i så hög grad som möjligt strävar efter att mildra överlåtelsens ekonomiska påverkan även i det fortsatta livet.
Detta arbete tydliggör de skattemässiga för- och nackdelar som kan uppkomma beroende på hur generationsskiftet sker, med fokus på rätthandlingar med köp- och/eller gåvorättslig karaktär. Men även vilka medel en företagare har att tillgå när det gäller att mildra och skjuta upp sin beskattning och hur nästa generation i sin tur kan nyttja dessa beslut i... - This essay highlights how a generational shift of a sole trading company can be implemented and what problems and dilemmas the concerned parties may face. A generational shift often involves tax-related consequences whereby both the transferor and the receiver, as far as possible strive to minimize the economic impact of the handover even in daily life after the handover.
This work clarifies the tax-related advantages and disadvantages that may arise depending on how a generational shift is handled. It focuses on the company assets whether purchased or freely handed forward. Also, the assets a company has available to it which can help them soften and postpone taxation and how the next generation, in turn, can utilize these decisions in...
