- Möjligheten till häktning vid misstanke om brott regleras i svensk rätt av bestämmelserna i 24 kapitlet brottsbalken. Och där i huvudsak av första paragrafen som talar om för oss att häktning får ske om någon på sannolika skäl är misstänkt för ett brott som har ett år eller mer i straffskalan. Utöver detta så krävs det också att där finns en risk flykt-, kollusion- eller recidivfara.
Utöver att bli häktad så kan det även bli aktuellt med restriktioner i fall där åklagaren anser det nödvändigt för utredningen.
Både häktningen och restriktioner kan skapa psykisk ohälsa för den misstänkte. Av den anledningen är det viktigt att inte häktning och restriktioner använda av ren slentrian utan att det är proportionellt mot det utredningsvärde som...
