Abstract
The essay investigates if gendered power structures manifest themselves in the Swedish law on sex crimes (2005:90) by analysing how the concepts of ‘sexual integrity’, ‘sexual deed’, ‘sexual molestation’ and ‘rape’ are depicted in the preparatory work of the law (prop. 2004/05:45 and 2004/05: JuU16) together with the Swedish government’s bill on tightened legislation for sex crimes from 2012 (prop. 2012/13:111), and what view on female sexual integrity that is constructed through these depictions. The essay investigates if gendered power structures manifest themselves in the Swedish law on sex crimes (2005:90) by analysing how the concepts of ‘sexual integrity’, ‘sexual deed’, ‘sexual molestation’ and ‘rape’ are depicted in the preparatory work of the law (prop. 2004/05:45 and 2004/05: JuU16) together with the Swedish government’s bill on tightened legislation for sex crimes from 2012 (prop. 2012/13:111), and what view on female sexual integrity that is constructed through these depictions. The essay does not investigate sexual deeds committed against children.
In order to answer what view of female sexual integrity that is constructed, the essay will investigate whether the intention of the perpetrator or the experience of the victim determines the type of criminal offense the deed is assigned. The depictions of the perpetrator’s and the female victims’ sexualities are also analysed.
The method used is a discourse analysis. Feminist theory is used in order to analyse the manifestations of gendered power structures in the preparatory work of the Swedish law on sex crimes. The material used for the theory consists of feminist theoreticians’ research on gender and sex crimes.
It was found that female sexual integrity is undermined in the primary material, through the use of a vague definition of sexual integrity and a heterosexual male norm for sexuality. It was also shown that the intention of the perpetrator often determines the assigned criminal offense of a deed. (Less)
