Sweetheart Deals between Pharmaceutical Companies: Consumer Welfare Effect of Pay-for-Delay Settlements through Competition Law and Patent Law

- Abstract
- The use of pay-for-delay settlements in the pharmaceutical sector, by which the entry of a generic drug into the market is delayed by way of a value transfer from the originator company to generic companies, have raised intense scrutiny by the EU and the US authorities. This thesis reviews the way it has been analyzed under European and the US competition and patent law. Also, the law and economics discussion underlying pay-for-delay settlements will be explored. Through these analyses, the thesis concludes that pay-for-delay settlements have a detrimental impact for consumer welfare.
