- Vi har under de senaste åren upplevt en allt mer intensifierad debatt kring den svenska lagstiftningen mot supportervåld och huliganism. Många är de som menar att vår nuvarande lagstiftning saknar en direkt verkan mot problemet och att förändring på området måste ske. Vår svenska lagstiftning är likt många andra länders lagstiftningar uppbyggd kring tillträdesförbudet. Det är den mest centrala och kännbara åtgärden vi har mot supportervåldet.
Kan man effektivt komma åt huliganismen om inte ens tillträdesförbudet ger en tillräckligt ingripande verkan? Vi behöver förstärka vår lagstiftning med utgångspunkt i tillträdesförbudet. Detta kan göras genom att hämta inspiration från England, där detta problem har varit betydligt mer utbrett... Kan man effektivt komma åt huliganismen om inte ens tillträdesförbudet ger en tillräckligt ingripande verkan? Vi behöver förstärka vår lagstiftning med utgångspunkt i tillträdesförbudet. Detta kan göras genom att hämta inspiration från England, där detta problem har varit betydligt mer utbrett genom åren och där man har lyckats hantera det på ett bra sätt. Det finns lärdom att dra både av åtgärder såsom det tudelade systemet för ”football banning orders”, men även från funktioner såsom kontrollperioden.
Den svenska lagstiftningen är vid en studie påfallande svart och vit. Det finns luckor som måste fyllas igen, och det saknas anpassning till olika situationer, något vi så tydligt ser i den engelska lagstiftningen. Jag kommer i denna uppsats fram till att den svenska lagstiftningen måste genomgå förbättringar för att mer effektivt kunna bekämpa huliganismen. Sådana förbättringar kan först och främst ligga i att utöka förbudstiden för tillträdesförbudet, men också genom att inhämta inspiration från det nyanserade engelska systemet. (Less) - Abstract
- This thesis will discuss the legal perspective of the problem with hooliganism in Sweden. Is the Swedish legislation sufficient enough to withstand and combat this slowly on-the-rise problem that we have with football violence? This question will be answered as well as what actions may be taken to rationalize and make the legislation more efficient. The Swedish legislation is focused around the equivalent of the football banning order, ”tillträdesförbudet”. This banning order is at the moment limited to last a maximum of one year, with the possibility to extend it for an additional year at a time. - This thesis will discuss the legal perspective of the problem with hooliganism in Sweden. Is the Swedish legislation sufficient enough to withstand and combat this slowly on-the-rise problem that we have with football violence? This question will be answered as well as what actions may be taken to rationalize and make the legislation more efficient. The Swedish legislation is focused around the equivalent of the football banning order, ”tillträdesförbudet”. This banning order is at the moment limited to last a maximum of one year, with the possibility to extend it for an additional year at a time. Recently, there have been a lot of discussion regarding this time limit and many lawyers, both researchers and practitioners have expressed a need to strengthen the legislation on this matter. Furthermore I will discuss the problem with the Swedish system regarding compensation of surveillance carried out by the police.
If the Swedish system is in need of change and improvements, can it benefit from taking in parts of the English legislation? I will compare the two legislations with focus around the different banning orders and try to investigate if it is a good idea to look to the west for inspiration.
After investigating both the Swedish legislation and the English legislation I have come to the conclusion that the Swedish legislation firstly needs to be reformed. It must meet the demands of the present problem. Secondly, Sweden may very well look to the west for inspiration. The English system has proven to be very effective against hooliganism and it is much more versatile in its structure than the Swedish model is. (Less)
