- Sammanfattning
Skuldsaneringsinstitutet är ett kompromissfyllt instrument där många intressen ställs mot varandra och det är i den allmänna skälighetsbedömningen som avvägningen ska göras mellan dessa intressen. Arbetet handlar om att beskriva den allmänna skälighetsbedömningen mer ingående utifrån dels ett deskriptivt rättsutvecklingsperspektiv och dels ur ett mer teoretiskt och analyserande perspektiv.
Huvudfrågan i arbetet är problematiken med ett vagt formulerat skälighetsrekvisit. För att besvara frågan beskrivs skuldsaneringsinstitutet och skälighetsbedömningen enligt både den äldre skuldsaneringslagen och den idag gällande lagen. För att besvara frågan beskrivs skuldsaneringsinstitutet och skälighetsbedömningen enligt både den äldre skuldsaneringslagen och den idag gällande lagen. Fokus har även lagts på skälighetsrekvisitets formulering med utgångspunkt i förarbetenas diskussion kring valet av antingen ett positivt eller negativt formulerat rekvisit.
Skälighetsrekvisitet är i lagtexten vagt formulerat och från början hade jag en föreställning att den vaga formuleringen vållade problem för rättstillämparna. I analysen ändrar jag uppfattning och kommer fram till att den vaga formuleringen är en nödvändighet för att skälighetsbedömningen ska fungera. Jag drar även slutsatsen att de i lagen uppställda särskilda omständigheterna borde tas bort för att garantera en nyanserad helhetsbedömning av gäldenärens personliga och ekonomiska förhållanden. Vidare anser jag även att skälighetsbedömningen inte påverkas märkbart av om skälighetsrekvisitet är negativt eller positivt formulerat. (Less) - Abstract

The institute for debt reconstruction is a process and function full of compromise
wherein the conflicting interests of several parties must be considered. Such conflicts
are assessed from the perspective of making a judgement of general reasonableness.
This work describes such judgements from legislative development as well as
theoretical and analytical perspectives.

required prerequisite of general reasonableness. In this work, I describe the institute
for debt reconstruction, as well as the judgement of general reasonableness, using

The institute for debt reconstruction is a process and function full of compromise
wherein the conflicting interests of several parties must be considered. Such conflicts
are assessed from the perspective of making a judgement of general reasonableness.
This work describes such judgements from legislative development as well as
theoretical and analytical perspectives.
I seek to clarity and reconsile questions raised by the vague formulation of a
required prerequisite of general reasonableness. In this work, I describe the institute
for debt reconstruction, as well as the judgement of general reasonableness, using
legislative records. I have focused on taking into acount legislators’ discussions and
within and throughout the legislative history of debt reconstruction with regard to the
use of positively or negatively phrased prerequisites.
My oroginal presumtion was that the inexplicit formulation of the judgement of
general reasonableness prerequisite was problematic in the interpretation and
application of the law. In my analysis I have come to the opposite conclusion and I
therefore maintain that the vague formulation of the prerequisite is necessary in order
to uphold the function of the judgement of general reasonableness. I have also come
to the conclusion that the specific circumstances mentioned inte the prerequisite
should be removed. To do so would guarantee a more holistic consideration of the
debtor’s personal and financial situation. Finally, my position is that the application of
the law is not affected by a positive or negative formulation of the prerequisite. (Less)
