Försiktighetsprincipen har utvecklats ur insikten att då vetenskaplig säkerhet väl uppnåtts
kring vad som orsakar miljöproblem, har skadan ofta redan inträffat. Principen tar därför
sikte på att agera mot skada innan den uppstått, trots brister i kunskapen gällande vad som
orsakar den. En mängd definitioner av principen finns till följd av det genomslag principen fått i internationella instrument rörande miljön och implementeringen i nationella rättsordningar. Detta innebär att formuleringarna definitionerna sinsemellan varierar. Samtidigt delar försiktighetsprinciperna i stor utsträckning vissa gemensamma
komponenter.

Försiktighetsprincipen har utvecklats ur insikten att då vetenskaplig säkerhet väl uppnåtts
kring vad som orsakar miljöproblem, har skadan ofta redan inträffat. Principen tar därför
sikte på att agera mot skada innan den uppstått, trots brister i kunskapen gällande vad som
orsakar den. En mängd definitioner av principen finns till följd av det genomslag principen fått i internationella instrument rörande miljön och implementeringen i nationella rättsordningar. Detta innebär att formuleringarna definitionerna sinsemellan varierar. Samtidigt delar försiktighetsprinciperna i stor utsträckning vissa gemensamma
komponenter.

Det har sagts att Sverige anammat en ”stark” försiktighetsprincip. I Uppsatsen undersöks innehållet i försiktighetsprincipen i miljöbalkens andra kapitel för att ta reda på om- och på vilket sätt denna kan klassificeras som stark i förhållande till försiktighetsprinciper i ett antal internationella konventioner och protokoll som Sverige har ingått på miljöområdet.

För detta ändamål tar uppsatsen utgångspunkt i en analytisk modell vilken tar sikte på att utröna innehållet i- och mäta styrkan i de olika formuleringarna som återfinns i de undersökta försiktighetsprincipernas olika komponenter.

Resultaten visar att försiktighetsprincipen i miljöbalkens andra kapitel är att anse som relativt stark i förhållande till de motsvarigheter som återfinns i de internationella åtagandena. Detta främst genom att graden av allvar rörande det potentiella hotet för att aktualisera principen är lågt ställt, att försiktighetsmått vid principens aktualiserande är obligatoriska och genom tillämpningen av en omvänd bevisbörda. The precautionary principle emerged from the insight that once scientific certainty is eventually reached concerning the causes of environmental issues, damage has often already occurred. The principle aims at acting against damage before it takes place, even though lack of knowledge about its causes exists. There are many definitions of the principle as a result of the breakthrough it has had in international environmental instruments and through a widespread national implementation. This means that the formulations vary between different definitions. At the same time, precautionary principles broadly share some common dimensions.

The precautionary principle emerged from the insight that once scientific certainty is eventually reached concerning the causes of environmental issues, damage has often already occurred. The principle aims at acting against damage before it takes place, even though lack of knowledge about its causes exists. There are many definitions of the principle as a result of the breakthrough it has had in international environmental instruments and through a widespread national implementation. This means that the formulations vary between different definitions. At the same time, precautionary principles broadly share some common dimensions.

It has been said that Sweden has employed a “strong” precautionary principle. This essay examines the content of the principle as formulated in the second chapter of the Environmental code in order to find out if- and in what way it can be classified as strong in comparison to precautionary principles found in a number of international conventions and protocols that Sweden has signed and ratified.

For this purpose the essay uses an analytical model that aims at scrutinize the content in- and measure the strength of the formulations that are found within the studied precautionary principles’ different dimensions.

The results show that the precautionary principle found in the second chapter of the Environmental code is relatively strong in comparison to the equivalents found in Sweden’s international duties. The main reasons for this conclusion being a low required level of seriousness of the potential threat that triggers the principle, mandatory precautionary measures when conditions are met and through the use of a reversed burden of proof.
