Abstract (Swedish)

Offentlig upphandling är en del i EU:s arbete med att skydda och främja konkurrensen. Deltagandet av SME anses vara en viktig del för att skapa en god konkurrens in Europa.

Denna uppsats tar upp frågan om offentlig upphandling med hänsyn till SME, gällande huruvida SME har möjlighet att delta i offentlig upphandling, både gällande de juridiska och faktiska möjligheterna. Vidare utreder uppsatsen även hur offentlig upphandling kan förändras för att öka möjligheterna för SME:s deltagande, samt frågan om förändringar bör ske och i så fall hur.

Det konstateras i uppsatsen att eventuella svårigheter för SME att delta i offentlig upphandling är att hänföra till de faktiska omständigheterna i upphandlingsförfarandet. SME hindras inte från att delta i offentlig upphandling genom regelverket. Mycket av den kritik som har framkommit är kopplad till hur upphandlande myndigheter genomför upphandlingar. Omfattande administrativa krav och omfattande upphandlingar är exempel på svårigheter som har lyfts fram.

Förändring av de upphandlande myndigheternas arbete sker för att öka deltagandet av SME i offentlig upphandling. EU-kommissionen och svenska myndigheter har publicerat vägledningar med förslag på insatser för att öka SME:s deltagande. Några av dessa insatser var uppdelning av upphandlingar i delkontrakt och ge leverantörer tillräckligt med tid för att sammanställa anbud.

EU-kommissionen lade 2011 fram ett förslag på ett nytt upphandlingsdirektiv. I detta direktiv fanns förslag som riktade sig till arbetet med att öka SME:s deltagande. Dessa förslag var bl.a. förenkling av informationsskyldigheten och möjlighet till direktbetalning till underleverantörer.

Direktivförslaget fick både positiva och negativa reaktioner. Ett flertal förslag, som förenkling av informationsskyldigheten, fick positivt bemötande. Förslaget som helhet fick dock en del kritik. Enligt kritiken innebär direktivförslaget att upphandlingsförfarandet blir än mer svårförståeligt.

Med hänsyn till vad som har framkommit i utredningen kan det konstateras att det finns vissa svårigheter för SME att delta i offentlig upphandling och förändringar bör ske. Dock borde dessa förändringar vara riktade mot alla eventuella deltagande leverantörer och inte endast SME. Förändring bör ske både genom lagstiftning och vägledningar. En förändring av regelverket bör ske för att få förutsägbarhet men det måste finnas utrymme för de upphandlande myndigheterna att självständigt utforma sina upphandlingar.

Abstract

Public procurement is a part of the EU:s work to protect and promote competition. The participation of SME is considered to be important in order to create higher levels of competition.

This thesis address the issue of public procurement with regards to SMEs, and whether SMEs have the opportunity to participate in public procurement, both in regards to the legal and factual possibilities. Furthermore, the thesis explores how to change public procurement in order to increase the opportunities for SMEs to participate. Also, whether public procurement should change and if so, how.

The thesis states that difficulties for SMEs to participate in public procurement can be attributed to the circumstances of the contract award procedures. SMEs participation are not hindered due to the public procurement regulation. Much of the criticism that has been highlighted is linked to how contracting authorities carry out contract award procedures. Extensive administrative burdens and large contracts are examples of difficulties that has been identified.

The work of the contracting authorities is changing in order to increase the participation of SMEs in public procurement. The EU-commission and Swedish authorities have published guidance documents with suggestions for measures to increase the participation of SMEs. Examples of such measures suggested included sub-division of contracts into lots, and allowing tenderers sufficient time to prepare tenders.

The EU-commission presented a proposal for a new public procurement Directive in 2011. The proposal contained provisions directed to increase the participation of SMEs. The provisions included simplification of information obligations and possibilities of direct payment of subcontractors.

The proposed new Directive received both positive and negative response. A number of proposals, such as the simplification of information obligations, received positive reception. The proposal as a whole was, however, given critique. The proposal was considered, by critics, to make the procurement procedure more difficult.

Given what has been highlighted in this thesis it can be concluded that there are some difficulties concerning SMEs access to public procurement, and there is a need for changes. However, changes should be directed at all possible tenderers, not only SMEs. Changes to public procurement should be done through both legislation and guidance documents. Changes to the legislation is needed to ensure predictability, but there must be a scope for contracting authorities to freely plan their contract award procedures.
