Observera bemötandet! – En observationsstudie om domstolarnas bemötande under huvudförhandlingen

Uppsatsen undersöker domstolarnas bemötande i brottmål ur ett rättssäkerhets- och effektivitetsperspektiv. Att delta i en rättegång kan vara en stor händelse i en persons liv och bemötandet under huvudförhandling kan ha en avgörande betydelse för dennas möjligheter att presentera sin berättelse på ett tillfredställande sätt. Syftet med uppsatsen är därför att ge en fördjupad kunskap om domstolarnas bemötande under brottmålshuvudförhandlingen ur ett rättssäkerhets- och effektivitetsperspektiv. För att uppnå syftet görs en sammanställning av tidigare brukarundersökningar i Sverige, som kompletteras av en egen observationsstudie av huvudförhandlingar i tingsrätt. För att uppnå syftet görs en sammanställning av tidigare brukarundersökningar i Sverige, som kompletteras av en egen observationsstudie av huvudförhandlingar i tingsrätt. Avsikten med observationsstudien är att sätta brukarnas upplevelser i kontext.

Förtroendeutredningen presenterades 2008 och visade på att domstolarnas bemötande generellt sett upplevdes som positivt. Utredningen konstaterade dock att det fanns områden som skulle kunna förbättras och det arbetades därför fram en bemötandestrategi som bland annat innebar att domstolarna skulle genomföra egna bemötandeundersökningar innan 2014 års slut. Flera domstolar har genomfört intervjuundersökningar med brukarna och resultaten från dessa sammanställs i uppsatsen. I analysen diskuteras dessa brukares upplevelser utifrån de observationerna som gjordes vid den självständiga undersökningen. Därefter ges även förslag till hur bemötandet skulle kunna utvecklas.

I analysen konstateras inledningsvis att den generella upplevelsen av bemötandet är positiv. Det finns dock flera aspekter i bemötandet som skulle kunna ses som problem, främst ur ett rättssäkerhetsperspektiv men även ur effektivitetssynpunkt. Utifrån både observationsstudien och brukarundersökningarna kunde det konstateras att brukarna upplever en stor anspänning eller nervositet under förhandlingen som vidare kan påverka möjligheterna att uttrycka sig. Bland annat framkommer att förutsättningarna för att föra fram berättelsen kan anses vara beroende av både den information som parterna får och huruvida rätten upplevs lyssna. Att parterna förstår språket under förhandlingen kan dessutom ses som angeläget för att de ska kunna bemöta argument. (Less)
Abstract
To take part in criminal trial can be an important experience for both of the parties. In this perspective the court’s treatment of the participants can be of great influence for their experience and the ability to present their statements in a complete and correct way. The thesis examines how the court treats the participants during the main hearing in the criminal procedure. The issue is dealt with in the light of the rule of law and the policy of effectiveness.

The thesis will first present theories of therapeutic jurisprudence and procedural justice. The research area has partially focused on how a legal process and the court’s treatment of participants may be perceived and effect people. Moreover, theories of what could be... (More)

In this perspective the court’s treatment of the participants can be of great influence for their experience and the ability to present their statements in a complete and correct way. The thesis examines how the court treats the participants during the main hearing in the criminal procedure. The issue is dealt with in the light of the rule of law and the policy of effectiveness.

The thesis will first present theories of therapeutic jurisprudence and procedural justice. The research area has partially focused on how a legal process and the court’s treatment of participants may be perceived and effect people. Moreover, theories of what could be considered as good treatment are presented. A section on the legal perspective describes the legal rules that judges must take into consideration in their treatment.

The essay also provides an introduction to the theories of the rule of law and the policy of effectiveness. According to the rule of law and the principle of legal certainty in particular, those subject to the law need to be protected from arbitrary use of state power. This requires that the court is presented with sufficient evidence.

The examination is performed in two steps. At first, previous studies of the participants’ experiences of the court’s treatment are summarized. Furthermore, these experiences are put into context with the results from a participant observation study performed by the author. The findings are then analysed in the light of the rule of law and the policy of effectiveness.

The analysis shows that although the general view is that the court treats the participants well, some aspects of the treatment seem to be problematic when seen in the light of the rule of law and the principle of effectiveness. The main hearing brings a lot of tension and nervousness, which may have a negative effect on the participants’ ability to present their statements. The tension and nervousness can in some cases be seen as a result of the court’s treatment. The lack of information about the process and court members not showing enough attention, are seen as some of the aspects that may influence the participants’ capability to leave accurate and detailed statements. Finally, understanding the language during the process is noted to be an important factor for the ability to respond relevantly to the opponent’s arguments. (Less)
