I syfte att skydda medborgare från övergrepp begångna av staten har ett antal europeiska länder undertecknat Europakonventionen. De fri- och rättigheter som Europakonventionen består av är allmänt formulerade och för deras efterlevnad ansvar både de länder som undertecknat konventionen och den Europeiska domstolen.

Europakonventionens rättsliga status i Sverige var till en början osäker. Svenska domstolar ansåg ända in på 1970-talet att Europakonventionens bestämmelser inte var direkt tillämpliga i Sverige. De fri- och rättigheter som Europakonventionen består av är allmänt formulerade och för deras efterlevnad ansvar både de länder som undertecknat konventionen och den Europeiska domstolen.

Europakonventionens rättsliga status i Sverige var till en början osäker. Svenska domstolar ansåg ända in på 1970-talet att Europakonventionens bestämmelser inte var direkt tillämpliga i Sverige. Det fanns även ett ointresse att använda Europakonventionen som tolkningsunderlag vid bedömningen av svensk rätt. På 1980-talet började ett antal svenska medborgare vinna mål gentemot den svenska staten i Europadomstolen och ungefär samtidigt började Högsta Domstolen använda konventionen som tolkningsunderlag. Europakonventionen inkorporerades i svensk rätt 1995 och blev då direkt tillämplig för domstolar.

Frågan om Europakonventionen var direkt tillämplig mellan enskilda parter på arbetsmarknaden dök upp i domstol tätt inpå inkorporeringen av konventionen. I doktrin hade sedan tidigare en livlig diskussion förts om Europakonventionen hade horisontell verkan mellan enskilda. En sådan verkan kom i doktrin att börja kallas för Drittwirkung.

Detta arbete syftar till att undersöka om Europakonventionen har drittwirkung mellan enskilda parter på den svenska arbetsmarknaden, och hur Arbetsdomstolen i sin praxis behandlat frågan.

En granskning av Arbetsdomstolens praxis visar att domstolen tillämpat flera av Europakonventionens artiklar i tvister mellan enskilda. Arbetsdomstolen har i flera fall valt att ge artiklar drittwirkung och på så sätt har dessa kommit att påverka relationen mellan enskilda. Då domstolens argumentation i flera fall är otydlig är det svårt att exakt utröna vilken påverkan Europakonventionen har kommit att få mellan enskilda på arbetsmarknaden. (Less)

In order to protect citizens from abuse commited by the state several
European countries signed the European Convention of Human Rights
(ECHR) in the aftermath of World War II. The rights and freedoms which
the Convention consisted of was generally formulated. Both signatory
countries and the European Court of Human Rights was responsible for its
enforcement.

Although Sweden was one of the original signatories to the European
Convention its status in Swedish law was uncertain for a long time. Until
the 1970s Swedish courts considered that the European Convention's
provisions were not directly applicable in Sweden. There was also a lack of

interest to use the ECHR to interpret Swedish law. In the 1980s, a number of
Swedish citizens started winning cases against the Swedish government in
the European Court and at about the same time the Supreme Court began to
use the Convention to interpret Swedish law. ECHR was incorporated into
Swedish law in 1995 and then became directly applicable to courts.
After its incorporation a question whether the European Convention also
applied directly between private parties in the labor market started to appear
in Swedish Labour Court cases. The issue had not been addressed in the
legislative history that preceded the incorporation and no support for this
were to retrieve in court cases from the European court. In legal doctrine a
lively discussion had taken place about the question whether ECHR had
horizontal effect between individuals. Such an effect came in doctrine to be
called for Drittwirkung.

This work aims to investigate if the ECHR has drittwirkung between parties
in the Swedish labour market, and how the Swedish Labour Court dealt with
the issue in its case law .
An examination of the case law of the Swedish Labour Court shows that
several of the ECHR articles has been in focus of attention in disputes
between individuals. The Labour Court has in several cases chosen to
provide articles with drittwirkung and thus giving them legal effect in the
relationship between individuals. Since the reasoning of the Court in several
cases is unclear, it is difficult to accurately determine the impact of the
ECHR between individuals in the labor market. (Less)
