- Abstract
- The EU is as a supranational organization based on the thought of the formation of an emerging common European economy. European Parliament and Council Directive 2004/38/EC was put into force in 2004 and is the latest involving the EU rules on free movement within the EU territory. The directive, called the directive on free movement, can also be seen as a part of the plan of a strong Europe given the freedom movement history,
which dates from the formation of the European Steel and Coal Community. With time as the European Community develops, it becomes more and more clear how aspects of rights influence the development of the freedom to move freely within the territory of the EU.

European Parliament and Council Directive 2004/38/EC was put into force in 2004 and is the latest involving the EU rules on free movement within the EU territory. The directive, called the directive on free movement, can also be seen as a part of the plan of a strong Europe given the freedom movement history,
which dates from the formation of the European Steel and Coal Community. With time as the European Community develops, it becomes more and more clear how aspects of rights influence the development of the freedom to move freely within the territory of the EU.
The development of economic cooperation to become a human rights project can also be discerned in the directive on free movement, where the rights of migrants seems to be satisfied, as the EU is changing its interest. The historic development of the directive may, among other things, be seen in how formulations of economic origin lives on in the directive, while such rights regarding entitlement to family and equality brought up.
Overall, the directive cannot be considered to have arisen as a result of a discussion of the individual right to move freely, but should rather be seen as a product of a historic economic discussion of economic growth. The influence of discussions on individual rights over the years is however substantial and the resulting directive available today can very much be seen as a document in which individual rights to liberty is strengthened.
