Abstract
Rape must be understood from a gender system and exposed women are often afraid of how they will be treated in the subsequent court procedure. The purpose of this essay is to examine how the Swedish courts construe women in rape trials and how this maintains and reinforces the gender system. To do this I am doing a critical discourse analysis of 20 reasoning of judgements with the theory of two feminist approaches, poststructuralist feminism and radical feminism. Rape must be understood from a gender system and exposed women are often afraid of how they will be treated in the subsequent court procedure. The purpose of this essay is to examine how the Swedish courts construe women in rape trials and how this maintains and reinforces the gender system. To do this I am doing a critical discourse analysis of 20 reasoning of judgements with the theory of two feminist approaches, poststructuralist feminism and radical feminism. The different stages of the critical discourse analysis reaches the conclusion that the reasoning of judgements construe women as passive in sexual relations, which perceive their body as open for the man. The expectations of how a woman that has been raped shall react before, during and after the actual act puts her in a position where she must follow the expectations to avoid an adverse affect on her credibility. This reinforces the gender system and the last part of the essay discusses how such enforcement of the gender system may be avoided. (Less)
